Oddydog still not BR .......... again!!!

Hi everyone - thought I would give you the latest news. After the clerk refusing to put my papers through last week due to possible stat barred debt and taking solicitor's advice who said BR was best option (see earlier posts), I had my rescheduled court date again this morning and I'm still NOT BR!!! The judge this time queried why I'm going BR as he stated the debts ARE stat barred - all except the one I'm paying towards, which I am happy to continue with and he told me that if I decided to pay my other creditors - which I didn't have to do, they would have to accept a very nominal repayment plan (which as per my SOA would be all I could afford), then they could make me BR. I must admit that I do feel 'empowered' - I was all prepared for BR but was very reluctant to do the deed. I have no assets worth anything so it's not as if I would have had anything to lose and now, I will at least fight my corner with the company that is chasing the old debt. I told them when I came home from court, that the judge refused my BR and why and we shall now have to see what happens. I gave them the court telephone number and name of judge if they wanted to take it up with him then they could. They said that wasn't necessary - so ......... I shall watch this space and keep you all advised.

Well you can't advice from a much higher authority than a judge! If you write to the companies chasing the barred debts and tell them straight that you will not be paying then OFT guidelines require them to cease collection activity and they can do nothing.
You are far better off having avoided bankruptcy and can begin to rebuild your life immediately knowing that the old creditors cannot touch you.
