Halifax loan shouldn't have been given to me!

I have just spoken to halifax loans about my loan hoping to get a reduction on the interest .... worth a try.....and they told me it was given to me fraudulantly <however it's spelt>

back in aug 2005 I popped into my bank to get a small extension on my overdraft limit, I was taken into a room and talked into taking out a loan to consoledate my debts I was given £4750 in total and £6725 to pay back over 5 years

I told them i was on income support and have child benefit back then but now the person I spoke to on the phone said I should never have been given the loan in the first place and there was fraud envolved

Where do I stand on this??? can I have the loan money taken back ... have to pay it off straight away??? Am I able to negosiate a cheaper pay back due to this ???

OMG just realised what if they charge me with fraud!!!! I have no proof that I told him I was on income support in the first place ... Please help

    You would have filled out an application at the time you took out the loan. What did it say?
    Do you have a copy?

    I would not worry about being charged with fraud right now. As long as you are paying it back it isn't fraud as such, because you don't intend keeping the money.
    What you might get is a CIFAS warning on your credit record to the effect that you made a fraudulant application. That will kill your credit rating stone dead.

  • I wouldnt mention it to the bank again, just pay it off ASAP.

    What probably happened was somebody working in the bank deliberatly put you down as working in order to sell you a loan and get the commision. This is the line your should take with the bank. If they put you down a CIFAS complaint against you on your credit report, then take this up with the ombudsman and also request compensation for the time its required you to sort out. You might get £100 or something for "goodwill".

    I didn't make a fraudulant application I told the bloke i was on Income support repeatedly and showed him on the computer screen of my statment the payments coming into my account and the child benefit payment .....he also asked about housing benefit and added that aswell

    they haven't phoned me back yet and i'm getting very worried, the bloke today kept saying I can't talk about it is is a fraudulant claim and shouldn't have been approved and someone will call me back

    I have a copy of the agreement july 2005 but I didn't fill out an application the bloke in the bank just put my information on the computer and applied on my behalf

    I'm still on income support so cannot pay it off asap i'm stuggling to pay it off as it is <haven't missed a payment yet >

    Hi, I am unsure how this would have happened, I had a halifax loan and I had to give my employers name and address and telephone number so I wonder what was put on your application ? Also I had to sign the credit agreement to agree that all the details were correct.
    Lets see if anyone comes back to you, if not I would leave it alone and try and pay it off or at least keep on top of the payments, can u not get any sort of income from anywhere else, also another idea is do u have any good close family who could help you out ?? ie lend you the money to pay it off or get a loan out for you (if your trustworthy) at a lower rate to reduce the monthly outlay?

    I can't remember what was exactly on the form it was 2 years ago, but i'm sure it just had my incomings income support, child benefit, housing benefit, council tax benefit as a combined figure £170 ish ...there was no employer, I was down as a homemaker and also single ... everything looked fine to me when i signed and I was never told I couldn't have one because I was on income support .... the bloke even deleted the payment protection section as I was already on income support

    I can't remember what was on the actual form as the agreement i have doesn't show any of that information, just t's and c's and payment details

    i'm dreading this phone call, I think they may have tried to phone me while i was picking my daughter up from school as i have a missed call withheld number on the house phone

    "Finances classed as income

    For loan application purposes, the following are accepted as income:

    Regular salary
    Employers pension
    State pension
    Regular commission
    Permanent overtime
    Incapacity benefit
    Severe disablement allowance
    Industrial injuries / disablement benefit
    War pensions
    Widow's pensions
    Working family tax credit
    Attendance allowance

    The following benefits will not be accepted as income for loan application purposes:

    Maintenance payments
    Rental income
    Child benefit
    Council Tax benefit
    Guardian's allowance
    Foster carer allowance
    Income support"

    The staff member should have known that this income could not be taken, although there have been some changes.

    Its more the staff members problem than yours, and that department is probabaly tracking what was keyed and by whom

    I was told by natwest that just on the tax credits I get each week I could get 7k in my own name. I am a SAHM.
    Debt free and plan on staying that way!!!!

    Just a thought, but maybe the person, who filled in your application is under investigation. This could be why the bank know that your loan was given under fraudulant circumstances. If this is the case, they will have gone through all the applications filled in by this worker.
    Surely they would not of waited almost two years, and then suddenly come to this conclusion on your loan, and then wait for you to contact them!
    Seems very strange to me.

    Oops sorry just re read your original post, and see that you informed them that you were recieving benefits when you got the loan.
