Employer issuing P45 on final day

My wife is is leaving her current employer and has got a new job - she has given 9 days notice (she only has to give 7) and her last day is next Wednesday 29th.

She obviously wants her P45 for her new job (which she starts on the 5th) they have told her they only terminate contracts on a Tuesday which will be the following Tuesday (4th) and then the P45 will be issued on the following pay day at the end of next month.

Is there really anything to stop them handing over the P45 on her final day?

Yes - it may be they do not terminate contracts on any other day but Tuesday. This will probably be for payroll reasons and they wont just run the payroll and close off someone as and when they leave. All leavers are done together normally.

No, but they have a process where they only deal with P45s on a Tuesday.

It sounds like they have planned the routine jobs throughout the week to help make things run smoothly. Getting a P45 a week late is no biggy. If she is that worried then she just needs to fill in a P46 on her first day.

  • My husband waited about 4 weeks for his P45,and he had been on 90 days notice,so they had time to get it ready.Although he filled a form in when he started his new job and they got his tax code right immediately...

You can fill in a P46 if you can't get a P45 in time for payroll. Any tax overpaid will be recalculated once the P45 is recieved and the tax office issue the correct code to the new employer (a couple of months-ish but the values shouldn't be significant anyway).

Last two times round I've waited in excess of 4 weeks for them to send it out - guess it's just a case of when it goes through. (last "employer" i waited 6 weeks - although that was lets face it, as unprofessional a workplace as it gets)
