Your boss is on your side from the sounds of things so that should go along way to getting it resolved. If he really does play it as an administrative oversight then I cannot backdate it to when it should have applied.
It'll depend on the size of the company too I guess as to how feasible it will be.Thinking critically since 1996....0 -

The clock starts much earlier than that, in this case you have to think about the date it was first reported the pay was wrong, it might be later, the date they agreed to change it or if there was a further pay packet with the wrong pay it might be that or sometime similar. but the safest date is probaly the first time it was reported.
They can not sit on it once the clock starts as you only have 90 days. I am sure someone will confirm this.

That's standard employer practice to avoid an ET, just let the time run out.

Yeah, shes really helpful and understanding (but a little on the soft side as far as discipline etc is concerned).
The company is large so can stand a hit of such a small amount that I am asking for compared to the millions in profits they make!
I still think they are going to try to avoid paying me and I am a little concerned about putting in a grievance in these hard economic times.
I am just a number to them after all and am expendible so if I do go down that route (if they refuse to pay), I will fear for my job!

The trick is to not get fooled by the boss they may be simpathetic but pathetic at the same time. They may say they are on your side but are they going to go the extra mile.
Thats why it is important to ask who said no and talk to them and if they say it is someone else go up to the top before going down the grievence route.
Also you need to find out who messed up the pay in the first place.0 -

Quick update.
I have just found a contract I apparently signed dating back to August 2010 stating that my salary is 18,100, a full 2,900 less then what was agreed between myself and my line manager.
I have never been on this amount at this employment.
I started on weekly pay to what amounted to 20,960 and that was 3 years ago.
Am I screwed here??
P.S. I work with two other people doing exactly the samr job. One of them is on 19,500 and the other is on 21,000.
Both these people have only been in the job for 6 months if that. I am the senior member of the team (as far as experience is concerned) and I also trained these guys up.
Any input guys?0 -

Besides 18,100 plus 2,900 is 21,000 and say you have been paid 21,960 - £40 a year short on what you say was agreed.
Having said that you say this salary started 3 years ago but only signed a contract in Aug 2010 which was 2 years ago, yes?
Why did you sign a contact saying you were on less than you were being paid?
A company can pay whatever they see fit to people doing the same job even if you do more, train staff, been there longer, answer all the problems etc. I have been there.0 -
Verbal aggrements can be part of the contractual arangment as can just paying the amounts.
What's written only form part of the agreement and the verbal agreements can overide this.
What did you agree, what did they pay and what pay is it that you think is missing.
There seems to have been a number of changes.
A full itiemised time line of pay and changes might clear up some of the dates
a line for each change
date basic pay bonus notes.
..... ..... .... ....
You need this to back up your claim.
if the written contract was clearly wrong from the pay before and after then it should not be an issue. but you need to be clear what is basic what is bonus/extras idealy these should be itemised on pay slips and any agreements email or letter best since verbals might be difficult to back up if they never got to payrole people.0
