Apcoa and roxburghe

On Saturday 14th April 2012 I flew out of East Midlands Airport. I was dropped off in a side street close to the terminal building and returned on 25th being picked up at the same point, a safe area I have used for several years without a problem. We were driven and collected by a relative.

On my return home I was faced with a parking enforcement notice demanding £100.00 with a 50pc discount if I paid within 14days and a similar notice 10 days later.

I then went onto several forums only to discover that I wasn't on my own and that many law abiding travellers were experiencing the same problems, many were scared as to what would become of them. I am reliably informed that the airport was private land and therefore I hadbroken no laws. So, on what I saw as good advice both from the forums and legal professionals known to me, ignored the notices. But the problem didn't go away.

Oh no! on 13th August I returned from a few days away to discover 2 Parking Enforcement Notices from Roxburghe Debt Collectors each demanding £100 plus £48 totalling £148 on each account with no explanation as to how this figure was arrived at. Since then I am having phone calls every day. I told the caller not to ring again as I considered it harassment and I would report it as such to the appropriate authority, the caller informed me that once a day was not harassment and that they would proceed to take legal action against me.

Having taken the matter up unofficially with amember of staff at East Midlands Airport, I was informed that APCOA had been tasked with the roll of improving road safety on the site, but as I see it,road safety was not an issue, on the contrary the car was in a safe area, furthermore you have to stop the car and get out of it in order to read the notice. Then it's not that clear.

The car used to obtain photographic evidence has been seen and photographed several times in the exact spot just to catch unwary drivers pulling up and stopping where I am alleged to have stopped, so APCOA are not by any stretch of the imagination improving road safety on the airport roads, but infact, neglecting it by just parking up hour after hour. I wonder if these cowboys were wheel clampers before it was outlawed?

I have 2 points to make.

1. Is EMA making so much money out of the traveling public that they are using scare tactics by proxy to deter people from using the airport?

2. Is it beyond the scope that at least one member of this forum do something about these unprincipledcompanies, who I am told are under investigation over its tactics

    As soon as you tell them to stop calling you then you can take action, you need to make it clear to who ever it is that calls you that ayou do not wish to receive any further comunications on this subject, as you will consider them ( the calls) to be harrasment,. also writing to the airport may be useful for that purpose. as the airport is responsable for the actions of its agents.

    If you live nearby the airport they have a comunity outreach team, where ( according to their propaganda leflet - comunity flyer) "The Team will be out and about in the comunity meeting people and answering your queries"

    Also, a quick search on this forum for East midlands airport will soon bring up plenty of other cases, if you realy realy want to go for them its the aiport that you should be challenging

    Just tell them this,

    that the call is being logged and recorded for possible legal action for harrassment, the debt is expressly denied, and you are to return it to your clients, any further calls on this subject will be classed as harassment and I will report you to the office of fair trading as you are ignoring guidelines.

    Put the phone down and start logging when you get calls, send them an email from a disposable email address with the same, you could also write to them if you wish to spend the money on a stamp. If they do continue calling you they are breaking the law

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    APCOA keep any monies they manage to con' out of any victims.

    EMA, as the landowner, are "jointly and severally liable" for the actions of their agents, APCOA and Roxburghe. Continuing calls would be judged to be harassment under the terms of The Protection from Harassment Act 1997.

    Roxburghe are under investigation by the Office of Fair Trading, who are "minded to revoke their (Consumer Credit Act) licence".


    The acquisition of wealth is no longer the driving force in my life. :)

We strongly urge you to seek independent legal advice rather than rely on these opinions, and we would respectfully suggest that you refer to the s52 of the County Courts Act.

    Its just garbage, graham white are roxburghe pretending to be solicitors. Its in your best interest to ignore them. Also to edit out the ticket number above as they can identify you with it.

    if a two way channel of comunication exists between you and Roxburgh ( ie they are pestering you with phone calls) tell them that all debt is denied, and they need to refer this matter back to their client, any further comunication from them will result in it being reported to the Office of fair trading, and you now consider this to be harrasment, from which you are considering legal action.

    Tell the idiots at East midlands airport that you are receiving threatening letters that you deem to be harrasment form one of their agents whose actions EMA are liable for, if they do not instruct their agents to stop sending these letters you may take action against the airport for harrasment.

    I would stronlgy advise going for the airport, TELL them that you will take action against them for harrasment, Graham white hardly sound like a reputable company.

    Hi, I'm on the third 'invoice' from 'Parking Eye' now. From reading a number of threads on this site am I right in saying they're not a legitimate company and this is a scam?

    I'm not overly worried about this and have ignored all three letters however I must admit I AM concerned about the mention of Bailiffs. I envisage being out of the house and my 14 year old daughter answering the door nd I get home to find belongings taken from my property! Could anyone please advise on whether or not they'd be allowed to do this? Where did the company get my address from? Why have they not been investigated if everyone is saying it's a scam?!
    I'd appreciate any advice.

    No bailiffs will turn up at your door, you would have to be taken to court, lose the case, refuse to pay within 28 days, and then the parking company would have to go back to court to instruct bailiffs.

    The chances of that happening are thus

    1.8m fake tickets issued in 2011
    49 cases before a judge
    25 losses for the parking company

    You do the maths, but it equates to a minuscule amount going to the small claims.

    they got your address from the DVLA, they exist in a very grey area where they can scam motorists, and because they don't do court they continue.
