  • Just referring to my original issue.... What about if they renew my contract as a 12 month thing again rather than making it permanent?? Where do I stand?

    IIRC they cannot simply extend the contract, a day over twelve months and you are permanent.

    Are you sure on that? it used to be a lot longer - 3 years I believe

    It is a day over 12 months, and we've found reasons to not renew contracts before now, including pregnancy, before the 12 months.

    Unfortunately, in tough economic times, it's something that some companies have to do. The employee in question is actually back with us again now, but she's well over the 12 months.

    12 months in, then 12 months pay (which is the case with all our contracts) at the moment just can't be done. We're financially strong for a reason.

    Wrong.

    A day over 12 months and you have the right to claim unfair dismissal, but it doesn't make a fixed term employee "permanent"; and I cannot claim the copyright to the following, which belongs to SarEl - "there is no such thing a permanant - any contract can be terminated".

    An employee can be kept on successive fixed term contacts for FOUR years - after which you have the right to ASK to be made "permanant" http://www.direct.gov.uk/en/Employment/Understandingyourworkstatus/Fixedtermworkers/DG_175138

    Do you have a copy of the employees handbook? Are you a member of a union? Is there any reason you cannot wait out the year to start trying for a family? IME people who fall pregnant with their first child start being distracted and their priorities change, even if they don't suffer with morning sickness and whatnot. Some people cover up great, others not so much.
