Agency pay mistake

I was taken on as a contractor with a firm, through an agency and offered a contract at a set rate per hour. I accepted the contract sent to me, signed it and sent it back (it was also signed by the umbrella company I use for my paye).

Then I was phoned by the agency to say they wanted to offer me a lower rate of pay (50p per hour less). I wasn't happy.

I started work, and after a chat with my boss, I found out that I should have been getting the higher rate, and the agency were misleading both him and me.

Now they've corrected the mistake and are paying the correct higher rate offered, but refuse to backdate it to when I started.

Do I have any chance of getting them to backdate - or even going to small claims court perhaps?

I've sent the agency emails that they've ignored, and called them, but they just say it's 'too much admin work'

    Never surprised by such stories, have kept clear of any sort of third party employment for years, best way I found to deal with them if its a last resort is lay it down from day one that you don't tolerate any messing about, lies or supposed administration mistakes/failures.

    Its business practice for many such organisations to try it on and play both sides along.

    You're self employed. You will have to pursue it through small claims court as you have no rights with the agency as an employee.
