Underpaid what's my rights?

Hi all

Hopefully someone will be able to help or give advice

I work for a large national company and have been employed over 12 years. A couple of weeks ago I read how my pay is made up an realised that I have been underpaid for at least the past 4 years as I have only been paid 1/2 of my Sunday premiums which I actually work. This calculated adds upto around £1000 per annum.

After taking it to my personnel manager a week later I was Informed that there had been an error and it was not set up correctly after a restructuring programme. But that I would only be paid correctly from now and that I wouldn't be offered any form of back pay.

I am currently waiting to discuss with my union but wondered if any one can help me??

Should I be able to get some level of repayment??

    Depends how far you want to take it.

    Talk to your direct management it is in their interest to keep you happy.
    (HR are there to do as they are told by the company)

    If there is still an issue and the union don't want to help

    You will have to go through the company grievence process.

    If you can show that they have not been paying your contractual pay then it may end up at an ET for illegal deductions/non payment.
  • Legally the furthest you can take it back is 6 years because the Statute of Limitations prevents claiming any further back than that.

    If they haven't paid you correctly they are in breach of contract. If they don't pay up you have two choices...

    1) Accept that it was a mistake, one that has now been sorted and move on

    2) Take it to tribunal. You'll get your money but you may find your card is marked.

    Remember though that if you've had any income based benefits such as Tax Credits, any amount you are awarded will affect it.
