    to clarify - when you say default notices, do you mean the mortgage company recorded on your credit file that they were missed payments?

  • The part about the default notice is only relevant if a default notice has been issued. If one has not, then don't mention it.

    hi
    rang abbey last night regarding my two late payments
    1st one dec since I had asked them to change the payment date since my
    pay day got moved. 2nd problems with wages last week due to company
    computer (had rang them the same to to advise) payment would be late.
    1st charge was due to them not changing the date intime.
    asked if she could take the fees off explaining notes on the file stating I have gave them two weeks to amend the dec payment, so the least they could do
    was take that one off. Well she lost it told me its not like the bank and I can't claim anything back. So I asked what the £32 was for and she said sending a letter. Oh I am sure you have made a mistake since the cost of a
    stamp is 32p.
    At that she said abbey don'nt need to justify any charges to me and put the
    phone down.
    Great customer service!
    do you think I can claim at least the dec one since it was they error
    surely you can change a dd date within two weeks.

    A couple of things spring to mind.

    Firstly these charges are just as unlawful.

    Secondly, it does take two weeks to make changes to a DD.

    One that says that their charge is unlawful, does not cover their liquidated damages (i.e. true costs) and is nothing short of a punitive fine that is applied 'ad terorem'.

    That should do it!

    Let me know how you get on Almond - i sent my letter 2 days ago (with the default bit removed). WIll be intersting to see if we get our money back!!
