I'd be grateful for any advice, I have an outstanding debt from last year when i was made redundant, i have had various letters from capquest, the usual that most people seem to get. I have felt quite frightened on receiving these, my original debt was for £1,000 to Littlewoods. After reading through the threads i felt even more unsure of what i should do, but this debt is mine and I would like to sort it out. I called the number on the letter a few weeks ago, spoke to someone obviously in another country, I could hardly hear them and their first language wasn't english! I am unable to pay the full amount in one go, so i requested a standing order form as the letter said on the back i could but was told that they were not able to do that, at this point I put the phone down not knowing whether a standing order form would come or not. Today i have received a letter asking for a reduced amount of £650 which it says i could make arrangements to pay off in instalments and if I don't agree by 18th August then a statutory demand will be serviced against me and i may have a bankruptcy petition against me. I do want to sort this out but am scared of ringing them after looking at threads on here, i'm thinking of writing to them and asking for a standing order form and proposing that i pay the requested £650 over 6 instalments, does anyone think this would be acceptable or is indeed the way to go. any response appreciated.

IMHO it's always better to deal with debt collection agencies by post as their phone agents are well trained in rudeness, intimidation and BS but poorly trained in much else. They are duty bound by OFT and industry guidelines to accept a reasonable offer, and your offer sounds very reasonable indeed... they are probably more used to offers of £1 per week! If they were to refuse your offer and you took it to the FSO I think there is little doubt the ombudsman would rule in your favour, and I would guess they know that. Don't be frightened by threats at this stage, they will bark a lot more before they bite, it's an industry that runs on fear and intimidation.0

£650 is there first offer. I would respond via a phone/email and backed up in writing that you can pay £400 in instalments as you were made redundant. They will probably bite your arm off for it. Also, make it conditional in the setting up of a standing order.
Bottomline is they want money, they have probably purchased the debt for a fraction of the face value. negotiate with them they offered £650 I would counter with £400 and settle for around £500.
if you have £400 at hand they might even settle for £400 straight off single payment. but NEVER PART WITH ANY MONEY UNTIL ALL IS CONFIRMED IN WRITING0 -
They have my shop direct account also. Never send the standing order form back to them as they ask. Then they will have your bank details to set up a DD should they feel like it.
Offer what you can to settle or pay monthly. Bought it for maybe 10%. Just ffered me just over 2k to settle 3k of unenforceable debt. Not a chance. Will aim for 1k

Forgot to say. As advised, only write to them. Never talk on the phone as they may say things they will never put in writing.:beer:0
