Apologies if the responses have not been the answer you require.
Doubt you will get the answer here. Maybe some highly paid lawyer could attempt to have the mortgage deemed unenforceable.
My cynical view is that you will get nowhere. Do you not think if the mortgages were unenforceable then every lender under the sun would have been recalling them at the time when equity far outweighed the mortgage?
If you got a letter saying your agreement was wrong so they were going to cancel the mortgage and take back the security would you agree? Of course not.
Pay the mortgage as you agreed to do when you signed the T&C's. OP ask yourself this.
If you were aware of a way to have peoples mortgages written off and homes retained would you:-
a) Place the information for public consumption within one of many forums set up for people to exploit loopholes to avoid paying their debts
or
b) Set yourself up as the most client friendly agent known to man and charge handsomely and fairly in order to save homeowners from paying for something they agreed to do so by signing the legal charge and T&C's?
Feel free to pursue this and part with your hard earned. I have dealt with clients who have unsuccessfully followed poor advice and ended up with a huge bill for the privilege. Not nice when somebody stands to lose their home due to believing what a faceless individual told them to be true.
