Hello
Just wondering if some kind person can clarify what happens now I have been temping for more than 12 weeks at the same receptionist position.
Usually for a bank holiday I have to take a days holiday out of my accrual, but now would I be entitled to this as a normal day because I have done over 12 weeks, ??
Should the agency be contacting me to tell me things will cahnge??
thanks

Why would things change after 12 weeks? I thought if you were with an agency, regardless of who you were working for, the same holiday procedure still applies.0

Twelve weeks is critical in relation to being paid at the same rate as would be received by someone employed directly by the client and also in relation to holiday entitlement if it would be more than the statutory minimum.
However the agency will still work on the same basis as far as holidays are concerned. You need to tell them that you want to be paid for the bank holiday and will be paid only up to the amount you have accrued.
What sort of business is the client? Do they have pay grades into which the receptionist position would fit? Do they give their direct employees of your grade more than the statutory minimum?0 -
Does the agency use the Swedish Derogation? If so, then there is no right to the same conditions as employees when you've been temping at a place for 12 weeks or more however when there is no work you continue to receive a set amount.0
