Recovering HSBC ERC after porting

Hi,
I recently ported my mortgage with HSBC to a new house (taking on some additional borrowing resulting in 2 mortgages). As part of the Ts+Cs we were required to pay a (very substantial) ERC on our original mortgage which should have been refunded to us however my advisor at HSBC is basically denying that we paid a charge despite that fact that we have documentation showing that we paid it. We'd also done our sums quite carefully and I know that if it had been transparently refunded to us then I would have needed to pay much less money to my solicitor to complete.
I'm at a loss to know what to do next, but being without this money is not an option... help!!

Send them a copy of your proof - presumably a copy of the redemption statement they sent your solicitor showing the charge included in the sum owed and confirmation from your solicitor as to how much they sent HSBC on completion.0

Yes I am trying to get all the figures together, it's made somewhat more complicated because I was one of the unlucky ones who ended up having 2 solicitors, my own and O'Neill Patient who were appointed by HSBC and therefore won't speak to me directly!0

Don't bother speaking to the mortgage adviser at HSBC if they fail to understand that you have paid a huge ERC and want it back, I doubt they will be of much help
Write or email a central complaints department, this should be on HSBC's web site0 -
If the sale/purchase were concurrent and the old mortgage and new mortgage did not have a gap inbetween, the question is why an ERC was paid in the first place?I am a mortgage broker.
