Mistaken online payment

Hello,

I thought I cancelled an online banking standing order for my rent payment which goes out on 1st of each month. To my horror, when I logged on it shows that the payment has been taken.

I rang my bacnk and they said that I need to contact the recipient and reclaine the money that way as there is nothing they can do. I contaced the recipent who is my ex-landlord from a previous flat and he said that he would look into it but he didnt sound like he was bothered.

Do I have any rights in terms of re-claiming this money? If he refuses to listen to my request, could I go to the police as a theft claim or potentially Small Claims Court?

Any advice would be greatly appreciated...

    How can it be theft when its been caused by YOUR mistake ?.

    I would suggest you ask nicely that the payment be returned and lose the attitude of your ex-landlord has done something wrong, and you may get a result.
