Loan off employer problem.

    but I had to pay 6 months in advance... otherwise they would not rent it to me...

    You didn't have the money so you shouldn't have rented from them. Why didn't you become a lodger somewhere, small deposit and much lower living costs.
    Not much of a friend if making you pay 6 months up front.

    As you have poor credit you need to be trying to improve this, saving your wages and stop taking other peoples money under false pretences.

    I am sorry but I am utterly confused, so it is hardly surprising that the employer is too. You started a new job in December, and by January your employer had relocated so far away that you needed to move? So you went to a work colleagues house in what - January? - and by February you had a flat - or you were staying with a friend - or you were staying with the friend of a friend? You had to pay six months rent in advance (which could be described as a deposit). So why didn't you in February explain this to your employer who lent you the money and say that in addition to the agreed repayment you could afford to repay an amount equivalent to the rent as well? That would have left you no worse off than you would have been had you used the loan for a deposit and been paying rent plus repaying the loan. And therefore not now in this fix...

    And now, 6 months on, you should have 6 months rent in your hand, no? So you could pay the employer back and show you have been trustworthy and get your full pay?

    I just couldn't afford the deposit and because I was staying at various places my wages was going on lodgings, and daily food and travel. My cost of living is now much cheaper because I have somewhere to stay. It is more of an aquaintance that a friend. Just soneone I know that rents out places.

    I moved into a colleagues house in about feb, when I moved out of a flat. I stayed there for about a month when he left and told me he needed me out.

    this is when I had time off work because I had nowhere to go. So I took the loan agreement and agreed to pay back over 5 months. I thought if I use it to pay for 6 months rent then I will have no rent to pay and I just pay back my employer. But now they have taken the whole amount back. If i cannot do anything about it I will have to grin and bear it and beg and borrow food, bus fare etc. but I only ask what (if anything) i can do. If nothing, then so be it.

    Still can't see where the rent money has gone if you had no rent to pay. You have saved this cost. And the whole story seems to have mercurial timescales.

    But let's see - technically, no, the employer cannot make a deduction from wages unless they have contractual authority to do so; they cannot legally take so much for an authorised deduction that the pay you get is below the minimum wage; and since they cannot buy your holidays off you then they can't treat your holidays accrued as part of the debt. OK?

    Now I suggest that you go and tell them that and stand up for your rights. At which point they will no doubt dismiss you for fraud because you knew what the loan was for, and you used it for something else. And if it isn't fraud, it'll be something. It doesn't really matter since you have less than 12 months employment.

    The law may be an !!! at times, but rarely on the side of the employee. Do you realistically see it siding with you when you have abused your employers trust and kindness in this way?

    Why hasn't your friend/acquaintance not given you a rental agreement for this 6 months? it looks just like you've taken this persons money under false pretences. If you had a rental agreement however, they may not be o peeved and go back to th original agreement. May not sort it out, but at least you look like you've done something official with that money.
    Data protection is there for you, not for companies to hide behind

    Let's not mince our words here. You played fast and loose with your employer's loan. You used it for vaguely the purpose you were supposed to, but not exactly the purpose. And by now you ought to have a substantial amount of that money repaid.

    What you have written above is actually bluff and bluster which hides the truth. But the only person you are fooling is yourself.
