Thanks for posting - glad it went well for you. Did you see/speak to OR at the court or did they call you? Only asking as if there is a possibility of me getting it all out of the way tomorrow, I would take my bank statements, bills etc with me tomorrow.

    Onward & upward for you!

Fingers crossed for you tomorrow oddydog

It can differ from court to court I spoke to the OR's clerk on the phone they'll ask me a few questions, confirming name etc and I asked them if I could carry on using my Coop Cashminder account as DD's go through it. They said they will speak to the bank and they would have no further interest in it.

Then in the post they send you 2 forms to fill in, the purpose of which is to ensure that you are aware of a number of duties and responsibilities required. You are agreeing to inform the OR within 21 days of any change in income/expenditure. The form also points out the bankruptcy restrictions which must be observed until discharge. Then the OR's clerk will ring to arrange a time and date for your call.

    Best wishes for tomorrow

Hello everyone :) Newbie on the thread but been a lurker/occassional poster on the forum as a whole for a few years now.

My bankruptcy court date is tomorrow! I've eaten half a tub of B+J's cookie dough ice-cream tonight and saving the rest for tomorrow. Keep thinking that there is something I haven't done and I'll get there and get turned away and have to go through all this waiting again. CAB has looked over my statement of affairs, I think I have the documents that I need, and when I called to make the appointment I asked what I needed and Im sure I have everything, but something is niggling.

Maybe its just that I can't believe that its finally here. It's such a huge step. For at least four years I've been filling the forms in, trying to save up for the fees, collect the documents, telling myself I'm going to do it, but always actually putting it off despite how important and necessary it is. Now, my three year relationship has broken down, me and my daughter have to be out of our house by 31st August with nowhere to go, my uni course is coming to an end in Decemeber when I'll finally (after seven years of uni) be a qualified teacher, and I just feel like its going to be such a massive new start in so so many ways.
Only two people away from a threesome :grouphug:

Hi MummyMoo and welcome to August's BR Club, I will add you to the front page

I'm sure you have everything but here is my tongue in cheek checklist, what to take to court :-

    - Your two copies of 6.27 and 6.28 and the Originals, do not sign them, you do this in front of the clerk. Your completed EX160 if applicable and any benefit letters as proof (dated within a month)

    - Money for bankruptcy fees.

    - Spare change for coffee machine.

    - Paper or magazine to read while waiting.

    - Change for car park.

    - Optional a friend to chat to/hold hand.

Do let us know how you get on after eating the other half a tub of B+J's cookie dough ice-cream ;)

    Best wishes

  • Hi

Hope everyone pre this post is doing well!

Not sure what Bankrupty invovles as such but if my partner's ex does it does anyone know where that would leave him mortgage wise? Would they place some kind of charge on any equity they may have in it and would that be restricted to 50% as it is jointly held?

Thanks and good luck to everyone

    :)

Hi everyone - my update as promised......
I had my court date this morning and guess what? I'm NOT bankrupt! After all the fretting and crying, I didn't even get to see the judge. The clerk at the court was concerned that my debts are all 'old debts' in that the last time a payment was made on them was over 6 years ago - she thinks they may be statute barred and unenforceable and has advised me to go away and think about whether I really want to spend £700 in this way. What really annoys me is that aside from a the CCCS, my husband had paid a company £300 to do all the paperwork for me so that there weren't any mistakes and they never even brought this issue up. As I reported yesterday, I changed the figures on my SOA to reflect exactly what we spend rather than their inflated figures. He is not a happy chappie. neither am I if I'm honest.... I have made a tentative appointment for next week as after then, the courts are full but I have the option to cancel. Any advice?? I know statute barred debts are unenforceable but as they still remain on file I would surely have the same balck marks only this time, they will never go - unlike Br when they eventually can be tidied up?? I would be grateful for your thoughts please.

:staradmin Hi Everyone and Welcome to the August's 2012 Bankruptcy Club :staradmin

This club is for everyone who has gone or going through the process of Bankruptcy during August 2012. So please feel free to join and post.

Pop your name on here, the date that you went Bankrupt and the stage that you are at now in your Bankruptcy. And then just keep everyone in the club updated throughout the next year about your BR journey. That way we can all stick together and compare notes and we will be there to support each other throughout the different stages in our Bankruptcy.
Remember this is your board so keep posting :hello:

Obviously anyone can come on here and post anything that will help us all and you are all welcome. Any important questions that need answering please still post them on the main board, as you will receive more advice and help.
Hopefully it will be an extra place for friendship and support as we compare notes and discuss what is happening with our Bankruptcies.

~ Please do not include too much information as the IS (Insolvency Service) are known to frequent this forum and they may identify individual cases, so username and date only, thank you ~
