i entered into a debt management programme with gregory pennington in Aug of 2008 to pay £5 a month of an overdraft with halifax. After 2 years of paying the £5 a month i came into some money and asked gregory pennington to arrange a settlement fee with halifax in oct 2010. Halifax then passed my file to the collections team to arrange a settlement figure. At this point they issued a default on my credit file even though i wanted to settle the account. They stated there normal policy for issuing a default when entering into an arrangement is to monitor the file for normally 3 to 6 months (maximum 12 ) and if your file does not change they send to the collection team where they will freeze the interest and issue a default at this stage. They have issued the only default in oct 2010 when i wanted to settle which is now really affecting my credit. Can i get this changed

This doesn't sound right to me. I don't believe they should have issued you a default in 2010 when you made an arrangement to pay back the amount in 2008 which was accepted.
Its the same old story which you hear again and again. Better and tighter control of legislation relating to applying defaults is needed in this country. The only advice i can give you for the moment would be to seek legal advice through the CAB. They can look at your situation more closely and advise you of the procedure to follow. This is no small task as once a default is applied it can take months of perseverance to even get them to acknowldege your complaint.
