please help - need to sort our debts (if any)

I decided to start another thread as my last one was specific and Im looking at more general advice.

Background: Rubbish with money, got into debt with various loans, store cards and credit cards.

Not had any credit given since 2005 and AFAIK nothing has happened to any of these since 2006. Although I have recently seen that if there is any CCJ's on my credits then these will still stand.

So first things first I need to look at my credit report? The last time I did this was in 2009 via Experian. Now I have got no idea of my log in details and I dont really want to get into a monthly payment for this. I have also looked elsewhere, but no-one can verify me. I have only lived at this address for coming up to 5 months, but my bank card is registered here and I am on the electoral register. How long do I need to live at an address for these companies to be able to verify me?

I did see on Noddle's FB page that they can only go back as far as 6 years so I might not have anything to show. Also another one (cant remember who) I did do as a trial 2 months ago did say that there was no credit what-so-ever on my account. I thought that they didnt really know what they were doing so I cancelled my membership. Others have also said I can't view my credit report recently (there is one that you pay £2 a time, can't remember who). Could it be that all my debts have been statute barred (or whatever the phrase is)?

Ive not had any letters since moving, but I did get a few at my old address.

I know Ive not done the right thing and I know Ive been burying my head in the sand, but Ive had that lightbulb moment and would like to pay something back. If there are all over I will donate money to charity instead I think.

Any help or advice would be very much appreciated. Thanks

You need to get your credit report from all 3 agencies, Experian, Equifax and Callcredit (free via Noddle). Once you have that then you have the information needed to start tackling the problem. If it has been over 6 years then they can longer take court action to recover their money. However, if they have taken court action in the past 6 years then it confirms you owe the money and they can take further action to recover their money. If it's been more than 6 years and you were to die your estate will have to pay them as one of your creditors (the debt is never written off) before passing any excess money onto your family.

  • Yes and yes. It's as if my credit report doesn't exist apart from experian but I can't get on that one and I don't want to get into a pay monthly thing if I can help it

No idea if its possible, but could the problem you are having getting a credit report be down to the fact that the debts were back in 2006 and so any defaults would have dropped off, and there is no credit report on you any more? If you have no recent loans or overdrafts thete may be nothing at all to see! Any debts that you did have may by now be statute barred if you have not paid or acknowledged them for over 6 years?

  • That's what I'm wondering Susie, but how do I know if I can't see anything? Do I just assume they are then?

Well if you have applied for a credit report I suspect any creditors you did have may well have been notified and will come out of the woodwork soon enough. If you were not on a payment plan I suspect that they would by now be statute barred because its probable that you stopped paying before the default date and if the defaults have dropped off they will be over the 6 year limit. Only ones that had a ccj would be collectable, and even then after 6 years it would not be too easy for them to go back to court to enforce them - Dear mr Judge, this person has not paid but we did not bother to chase even though (s)he was on the electoral roll,...

  • So what do I do then? Nothing? Just give some money to charity (I want to pay something somewhere and feel really bad about it all now)

Well if it was me I would much rather give to a charity than a possible creditor who has not bothered to trace you even though you were on the electoral roll, but its entirely up to you :D
