i have 2 houses,1 with the missus which has no equity,and 1 my dad lives in with about 40,000 in equity.i cannot borrow anymore because i dont earn enough.QUESTION is how can i get my hands on or part of the 40k.

There's any number of 'funny' responses to this question! Sounds like you're desperate (can't borrow any more). Leave dad alone, if he has equity as you say he's presumably still paying the mortgage. Leave him and his equity alone, at least for now and find another way yourself to raise the money you obviously want.
