Good morning,
I've taken a look through the forum but couldn't find anything that matched my problem so thought i'd get some information.
I checked my bank account yesterday and £973 had been withdrawn by CahGenie who i had a payday loan with previously. I admit that i found it difficult to pay this amount before as it had spiralled from the £200 i had originally borrowed.
The problem here is that the bank account where they took the money from was not one i had given them details for. It was not linked to the account they have on record in any way shape or form.
I phoned them and asked where they had got my details from and they told me they had obtained them from an application i made to another finance company in June (although i honestly cannot remember doing this).
I was just wondering if it is possible for them to even do this? Is it in their terms and conditions and is it even legal?
I have a print screen of my account i originally opened with them and it clearly states my old Nationwide account, the account where they have taken the funds from is a Natwest account!
They said they would look into this if i got a crime reference number, but as i can't remember making any new credit applications i am worried that i may be charged with fraud if in fact it was me a month or two ago!?
I would really appreciate any help on this and whether i should bother doing anything at all?
Your help woul be much appreciated, Thank you all in advance.

In which case this is an unauthorised transaction and you need to contact Natwest and instruct them to reverse it - they have to do this immediately.Mama read so much about the dangers of drinking alcohol and eating chocolate that she immediately gave up reading.0

This is very common when they operate under various names.
I doubt they simply guessed the correct details.
Strange that after dodging the repayment with one company, you applied with another one. Who is commiting what could be considered a crime here?
What you should be doing, is stopping the applications for silly loans, arranging a method to clear your debts and start a savings plan.0 -

You must have applied to two loan companies operated by one overall lender.
Unfortunately for you, you gave each company different bank account details.
Fortunately for the company to which you owe money, they have access to both accounts and have taken what you owe them from the account which had money available.
The company concerned have done nothing illegal. All they have done is take money you owe them from an account you gave them. It's not their fault you didn't check that the two companies were related.
So to sum up, they have only taken from you what you owe them. There is nothing illegal in that."There are not enough superlatives in the English language to describe a 'Princess Coronation' locomotive in full cry. We shall never see their like again". O S Nock0 -
if you can afford the payment is it not better just to pay them?0

Well done on clearing the debt though!0

I think you mean "I admit I didn't pay back what I had agreed to when I took out the loan..."I was just wondering if it is possible for them to even do this?Is it in their terms and conditions

"Debit Card Details" means your debit card details you provided to us when entering into this Agreement or such other debit card details as you have told us about since entering into this Agreement for the purposes of repaying amounts due under it.

8. You authorise us to collect payments of the Total Amount Payable in 2 repayments as set out in this Agreement by using your Debit Card Details. You also authorise us to use your Debit Card Details to collect any Additional Charges and the Second Repayment as set out in clause 9 and clause 11.

So, as you did not provide the other bank account details for the purposes of repaying amounts against this loan then maybe they have not kept to the agreement.
On the other hand, you have not met several of the obligations you agreed to.they told me they had obtained them from an application i made to another finance company in June (although i honestly cannot remember doing this).loose does not rhyme with choose but lose does and is the word you meant to write.0 -

I have to be honest myself and say I find it surprising you can't remember doing this. One imagines that you applied again while struggling to pay off the initial one, surely?
If the £973 they took has ended up clearing the debt, I'd just accept it is done and dusted, and make a note to self not to let such a tricky situation develop again, because payday loans are just not good to be getting into a mess over.“In any moment of decision the best thing you can do is the right thing, the next best thing is the wrong thing, and the worst thing you can do is nothing at all.” - Roosevelt0 -

It's somewhat worrying that you at least admit the possibility that you might have applied for another loan when you had failed to pay of an existing one.
i think its more worrying that someone makes so many applications that they cant recall WHO they applied too..
