Back From the Courts

Hi everyone,

The day started really well, when we were late to school and my 3 year old decided she was not going to playgroup... so I was 15 mins late to court.
The only other person there for BR was a friend of ours who hadn't told anyone either. We waited for 1 hour then saw the clerk. (He was a bit of an a***) checked the forms, was extremely patronising and made me feel rubbish. I had missed out loads of bits, so it took an age to sort that out. He took forms of to the Judge.

Waited another hour, then the (Lady) judge called me in alone. She was concerned that my husband may have bullied me into going bankrupy, and I had to explain that all 'his' debts had been ours, and that although mine were low we could not afford to pay them off. Mine totalled £5109 and his £20394. She called him in and seriously told us the consequences. Asked where we had sought advice (payplan, myvesta, cccs and the insolvency service.) Then said that if we told the truth we may not be allowed visa's to certain countries (where?) and that we would find it difficult to get credit (good). Then she stamped and we were out.

We then had to wait another hour for the OR to call. He basically said he would send us a pack and then we should send all our info. I asked about the housing Benefit and Child Benefit due in the account tomorrow, he said that he would arrange for the money to be released. I asked if I could withdraw it, and he said he would fax them immediately and that I sould withdraw it tomorrow. (How embarrassing will that be. I bet they have cancelled my card so I will have to go into the bank. What if they don't give it to me. What if they say that the money I withdraw for the fees and rent etc was illegally withdrawn)

Anyway then it was all over and we left. Feels really weird.Can't beleive that is really it.

    sorry to hear you were put through the mill in court but at least that part is over now.i cant offer much advise on the bank senario other than if they refuse to allow you to withdraw the money then contact you OR as soon as possible,im sure this is right but can check later but the banks are not allowed to withold benifits .

    The judge was quite nice actually. I think it's weird because you feel quite happy but at the same time a bit crap. My brain is wrestling with the seriousness. I mean as far as I can make out, the only kind of credit I would ever want is a mortgage. It seems that this is still possible, but at a slightly higher rate. To be honest my our credit rating has been shot for years and we were even turned down by Citibank (only 1 late payment on Next account). Honestly I have lived under debt for years with only Natwest offering us more and more loans/overdrafts, based on our custom with them. So even if we weren't bankrupt a mortgage would be difficult to get.

    Is everything on the forms really cancelled out now?

    Feels weird doesn't it? - all gone, just like magic :cool:

    Don't forget to take I.D with you to the bank tomorrow but I wouldn't be surprised if you can still use your card.

    I was on a training course when ours went to court, we didn't petition ourselves, I started the course with something like £220k of debt and during the first break I got a call from our solicitor, "you're £220k better off than you were this morning". Strange feeling.

    Bet your glad its all over now. Sorry you had a bit of a hard time, but that bit has gone now so it can only get better from here on in.

    I still cannot get it, I am still shaking each time the phone rings or someone walks past the house, guess thats just years of hiding and I'm waiting for the catch, just hope thats not next Thursday during my interview.

    Hi Vix

    The weekend will give you time to digest the day's events and by Monday you will feel like a great weight has been removed from your shoulders.

    You will also discover that you have not changed colour overnight and the word bankrupt has not been mysteriously tattooed on your forehead.

    If fact life goes on as normal but without all that debt. The kids will still drive you mad, hubby will still get on your nerves, but it all becomes much easier to deal with.
