Was my JSA claim rejected?

I've been claiming JSA, I've been to the job centre twice to sign and for my first advisor meeting. Recently I got this confusing letter which says I can not be paid from the 13th of June and the 2nd of July because I'm "in full time education".

Here is the actual letter: http:// i50.tinypic .com/smt82v.png (without spaces, I can't post complete links as a new user).

I'm doing this in the long summer holiday I have between college and university, although everyone has finished college I wouldn't be surprised if I was technically in education.

I'm confused because there are two dates. Does it mean I will not get paid at all, or that I wont get paid for certain time periods?

  • It sounds like the official term end date is July 2nd. You should be eligible after this date.

I would just ring them and ask them its the best way to get a clear answer

Even though it says "we cannot pay you an allowance from 2 July 2012"?

Sorry, I couldn't get the link to open - got it now.

Are your parents still receiving CB/ CTC for you?

    No they aren't.
  • No they aren't.

When did they stop claiming, or are you estranged from/ not living with them? Are you 20 or over?

I'm living with them, apparently it stopped months ago and they aren't entitled to it anymore. I will be 20 in August.

If your course was classed as non advanced education, they should be entitled to CB/ CTC until September. What level were you studying at? If the JCP think they are claiming CTC/ CB, this will be why your claim has been declined.

If the CTC/ CB was stopped correctly, then you should be able to claim from the end of term - you need to advise the JCP that the course you start in September is a new one, and hence you are no longer in FTE.

My course was a level 3 BTEC, on the same level as A-levels. I know that's ironically not classed as advanced education. So you think that my parents should be receiving child benefit?

If it matters I've spent two years in sixth form, and two years in college. I've been able to claim EMA for 3 of those years.

I can't ask them about it at the moment, but I will when they get back.

I'm not sure to be honest, although you are still the correct age for them to claim, the fact that you have done four years at the same level may change things.

Give the JCP a call tomorrow, see what reason they give for thinking you are still in education. It may be a simple mistake, they may think you are continuing on the same course in September. If the reason is to do with CB/ CTC entitlement, you will need to ask HMRC if you parents are still entitled to that.
