Termination of Employment

PPI Party Pooper
My 16 year old daughter has worked as a p/t customer service assistant for the past 10 months for a large retail company. She has a PERMANENT CONTRACT which states that her job title is PERMANENT WEEKEND CUSTOMER SERVICE ASSISTANT. She was today called into the managers office along with 3 temporary staff and handed a personal letter. The letter states that there will be a meeting with all temporary staff on 4th August 2012 to discuss the possible termination of their temporary contracts. She did tell the manager that she was not on a temporary contract and he asked how she was paid. She stated that she is paid weekly and he replied that she must be temporary then and dismissed her complaint. I know that she has only been there a short time and has no redress but would just like to have some thoughts on the matter as obviously she is very upset.

    What does the letter say? They are making redundancies?

    If the letter says the meeting is for temporary contract workers then does she need to attend.

    Who is the letter from? any HR?

    10 months service they can get rid of anyone so tread carefully.

    The letter reads as follows 'Dear xxxxxx, I am writing to invite you to a meeting to discuss your temporary employment contract. The meeting between you and I will be held in the training room at 9.30am on Sat 4 August 2012. At this meeting you have the right to be accompanied by a representative, either a Trade Union Rep or colleague. The likely outcome of this meeting will be to end your temporary contract with xxxxx with an appropriate notice period.' The letter is signed by the Store Manager.

    The letter does say the meeting is for temporary workers but it is specifically addressed to my daughter. It is from the Store Manager. I know that she has little service and virtually no rights but I am concerned that they have made some sort of mistake. The letter reads as follows 'Dear xxxxxx, I am writing to invite you to a meeting to discuss your temporary employment contract. The meeting between you and I will be held in the training room at 9.30am on Sat 4 August 2012. At this meeting you have the right to be accompanied by a representative, either a Trade Union Rep or colleague. The likely outcome of this meeting will be to end your temporary contract with xxxxx with an appropriate notice period.' The letter is signed by the Store Manager.

    Get her to take her contract and just produce that. They have obviously made a mistake and since she has already pointed out she is not a temp but it was dismissed I would attend if I was her and take it to show them. Having said that, they should have a copy of her contract.

    This is where having an ear to the ground and the rumour mill helps.

    The chances are this is a mistake BUT it might be they are still looking to terminate just got the letter wrong.

    Perhaps a enquiry with HR, is there another worker that has not got the letter that can do some digging around to find out what is going on.

    I can't offer any useful advice, but I just wanted to comment that it would be a crying shame if your daughter lost her job. At 16 she is obviously trying to pay her way and get a good work ethic and provide for herself by giving up her weekends to work part time. I hope if this doesn't work out she can find another job. Best wishes.

    Thank you. I agree I know that if they are going to make her redundant there is nothing she can do about it because of her short service but I would hate to see her lose her job because of an administrative error. She has given up her weekends for the past 10 months to work as well as taking her GCSE's so it has been hard graft for her.

    Either A) they got their facts mixed up
    B) Perhaps they are looking to terminate her job (perhaps they haven't got any work) and are using the 'last one to be employed gets the sack first'

    Is she working extra hours over the summer holidays? Ie has a temporary extra hours contract alongside her permanent part time one
