Credit Score Unfair Blemish

Hi all,
I've been a little outraged about this for a few years since it happened. The main fact is that I have a default on my account from it and it wasn't my fault.
It all started on 25th October 2008.
I went into Carphone Warehouse and was interested in getting a subscription deal on a Web Book (a spangley new thing at the time). I spoke to the Sales Assistant at Carphone Warehouse in Crayford, Kent and I liked what I saw.
Throughout the sale, I reiterated over and over that I would only purchase a web book should the Mobile Internet be unlimited Upload/Download and uncapped as I would be using it a hell of alot.
He assured me that the 3G product I was getting did just that. So, I signed up for the mobile broadband and got my free web book. the deal was £20 per month for 2 years, I was cool with that.
Low and behold after the first month my bill came in from 3G and it was £93 for that month!!
I went straight back to carphone warehouse, confronted the gentleman and forced them to take back the web book, the dongle all in its packaging.
When telling 3G that CPW had mislead me, misrepresented their product and I was dealt with unfairly, they said they would sort it out (UK call centre)
It wasn't sorted out and after months of arguments with Indian Call centre representatives, I finally paid them the £93 under protest and they cancelled the account.
However, they have left a default on my credit score and the balance says £93 instead of £0 and it says account satisfied instead of settled.
I have a mortgage broker coming over monday evening and I don't need this rubbish in my file when it was not my fault at all.
How do I rectify this?

Well firstly this is not easy. It's been a while now and that question may be asked.
Firstly you should always write and never use the phone, if you do call you need to write after and confirm what has been agreed.
The problem with the Indian call centre is not the staff, but the fact that they are only given limited authority and to be fair they are worked very hard!
I think you need to obtain the report, print it and send it to them with a letter explaining exactly what you have just said.
There is no point trying to call and expecting the situation to be resolved. It may take many months and you may need to approach the FO for a final decision. Remember if they agree to remove the negative data then you will have to wait approx 6 weeks for the updates to go to the CRA'S, unless they use the fast system, but I have never seen it myself.
You are saying they are wrong either way, so that will be the first step, you then just need to fight for the full removal. I can't understand why it went to default and not just to missed payment, if they had not accepted the cancellation I would have expected them to chase the full contract value and not just the £90 odd quid. Usualy it goes 1, 2, 3, 4, 5, missed payments first :cool:0 -

I have had many issues, I was right in some and some I just took a chance to get what I wanted.
Always seems to be the genuine ones you loose on, it's quite upsetting!
Just keep pushing and keep strict records, as you may know often these companies don't and it can help you prove the company is s*** when you go to the FOS. This always helps prove your complaint.
I won a case against;
Littlewoods - I shouldn't have
Halifax - I should have
I lost a case against;
Santander - I should have won as they screwed me over over a few pence.

Very true! I complained to the FOS and they dealt with my complaint about T-Mobile... Why would this be? Is it anything to do with fraud as this was also included in my case?
Having said that it was settled at investigation stage, maybe nobody had read the blo*** thing ... :-)

I saw a mortgage broker on Thursday. My boyfriend had a late payment from 02 from 2008 I believe. The broker told me that mobile phone late payments are not important as they throw them on all the time. It might still be annoying but it shouldnt get in the way of your mortgage J x0
