Credit Agreement gone wrong

    I sent her a letter that broke down each payment that I have made for her (normal monthly payment + penalty charges) in February and March and also that I have suspended the direct debit going from her account with Hitachi. I have asked her to pay me £396.72 by 27th April or I will pursue the matter through the court. The letter was sent Recorded Delivery and on checking the Royal Mail Track and Trace service, she has signed for the letter today. I've just got to wait and see now. I don't actually know if she has a bf living with her but she gets disability allowance and income support because she is partially sighted. She also gets maintenance from the CSA from her ex. I think she actually gets more a year than I get paid for working full-time (not 100% on that, just a guess). I don't get a penny off my sons father, even though the CSA are involved, I get nothing. That's taking us off the point though.

    I have all her text messages from last month promising to pay me back what I had paid. She even told me what date she would get it to me, but that never happened.

    I've asked Hitachi for (and have received) the original agreement with her address given as the delivery address. They are also in the process of sending me the entire call log that is on their system, that also show calls off her from last year when she missed a payment and I told her to sort it out with them by using her debit card.

    I just hope I have got enough for the courts if it gets to that!!!
    I'm not soft and will take it all the way, she is one person I can afford to lose as a "friend"

    Aaaaaaargh.
    I went out for a meal last night with my friends and went to our local club afterwards just to spend an extra half hour with them (don't see them very often). Who should be out but my "friend" that owes me all this money. The "friend" who says she hasn't got a penny to her name!! She has had her hair done since I last saw her (darker than her natural colour so that must take some upkeep!!). My cousin took a picture of her, telling her that it would help me in court (doubt this statement). I just think my cousins' blood was boiling as much as mine!!
    I'm not saying she can never go out again - but she has told me she doesn't have a penny to her name. I've been told she is out every single weekend.

    How angry was I!!!!!!!!!!!!

I was told that if I went and knocked on the door and told her I am collecting the sofas and I then forced my way in, that would be classed as breaking and entering. I'm never going to get my money back and this would seem the best option because I can clean them up and sell them on.

    I'd strongly suggest you don't try to remove the sofa yourself. You could get into all sorts of issues here and it'll not help you if you go to court. Do everything by the book then she'll have no leg to stand on when you go to court.

    I don't think I would have the strength to move the sofas ;)
    I just wanted to know if I did seriously think about getting the sofas back, to save going through the courts, how I would go about it?
    Seeing her out drinking made my mind up for me anyway. I'll give her the 28 days to respond to my letter and then set the ball rolling. I don't think she is taking this so seriously, so she will get a shock when the court papers drop on her mat.
