Our joint account was overdrawn, and my parents paid money in to cover our rent and bankruptcy fees (£1300+£300 for car tyres and food) we had hoped to have a basic account up and running but citibank turned us down.:mad: So I need to withdraw all available funds for living until an account is up and running. Is this ok?
Also is it ok to re-direct all benefit payments to my mum's account whilst we have no bank account? or can they put them on hold until we have an account.
Help please!

Yes - its okay to withdraw your living expenses! And you can have your money paid wherever you like for the time being.
You wont be the first person to have to do this with payments, wont be the last and OR's understand this.

Hi Savage, Draw that money out quick and keep it somewhere safe. My account is not yet frozen but since being declared BR yesterday I am not going to use any cards in my name. When OR called me he advised me to get any benefits paid into another account until I get a new account set up so do that now.
Good luck 4 tomorrow......it's a lot less stressful than we all imagine before hand and is over before you realise. Don't forget to come back and let us know how you got on. Have a good drink afterwards and keep your head held high, be proud that you are doing the right thing. I am really confused, child benefit has been sent to my account already. It will appear on Saturday, but they cannot stop it now.
Do I change my court hearing till next week or shall I just loose this money? (£279) sorry if this sounds really bad, but the lady at the court said no probs with rearranging for next week, but the sooner the better. (I wont be able to withdraw over the weekend if declared bankrupt tommorrow)
And won't the bank get suss if I withdraw a wadge of cash?
I can explain most of the spenditure to the OR (rent car tax, br fees and food etc) but will they ask for it back.

I have a payment due in to my account next Monday, my OR advised that he will arrange for this to be released to me as I don't have time to change it before hand, I am sure they will do the same for you. Also the bank account is not frozen instantly, the OR sends a letter to them to advise that you are now BR so you should still be able to withdraw this money on Saturday.BCSC Member No 55 - Lightbulb Moment 07/03/07

I think the best person to ask is the OR - can you telephone them now?
I'm sure if you explain the Child Benefit to them - they'll understand, and common decency suggests they shouldn't touch it.
After all - if you'd already quite legally arranged to have it paid into someone else's account - they wouldn't complain. De facto - they shouldn't now.
Give them a ring.

If you go ahead with it tomorrow then ask to speak to the OR before you leave and just explain the situation to them, I'm sure they will understand and will want to help you. If you are really worried then you could either try to speak to them before you go or change it to next week. I must admit that I wanted to take the last bit of cash from my account but won't as I am worried that it would be wrong to do this, I'll just wait till next week as my OR said he will release my money to me.BCSC Member No 55 - Lightbulb Moment 07/03/07

The bank will not freeze the account until they are contacted by the OR as it is the bank who freeze it NOT the OR. Speak to your OR ASAP and explain the situation with the CB going in. It is more than likely that they will still let you withdraw that money
Regarding the account, I suggest you empty it before your hearing. If the OR asks questions you can tell hiom it is for your living expenses until you get your basic account up and running.

Our local court doesnot have an OR. They are based 60 miles away. So we will receive a phonecall from them at the court when they will arrange a telephone interview or visit (prob phonecall as we are far away) so I can't really ask them.:starmod: I am not that savage :heartpuls But I am a Vixen :staradmin0
