Refund of Care Home fees

There's a lot of publicity at the moment about reclaiming Care Home Fees for those who suffered some form of Dementia and were cared for in a nursing home.
I'm trying to establish whether my wife would be able to make a back claim for her father who suffered from vascular dementia and was in a nursing home for a few years before he died.
I'm unable to find anything in these forums and wondered if anyone could point me in the right drection or explain the claim requirements for me.

  • I think its about the National Framework for Continuing Health Care and relatively recent changes in Law which means that the post-code lottery of assessments for NHS funded healthcare was unfair and as such a common standard should be retrospectively applied in certain cases.If successful those individuals of their estates could have the monies they have paid refunded.

    There are certain deadlines.. I suggest you seek legal advice from a specialist Solicitor and advice from your local Primary Care Trust

    As far as I can tell from the web it's only applies to those who were discharged from hospital, or care by a registered nurse, into a care home. My father in law went from his own home into care so I don't believe it applies under those circumstances.
    But I could be wrong.

    I think each case is considered individually. It's a thorny path and I wouldn't rely too much on any information from the PCT.

    Age UK is a good place to start. Also, go to the Over 50s board and read the thread by monkeyspanner.

    Although it is more normal for assessment of CHC funding to take place on discharge from hospital it can be requested at any time and the funding is available in any setting including own home. So funding is not restricted to a care home setting. MSE have just launched a campaign to encourage people to make claims as deadlines for retrospective claims are looming. If you want to fing out more search MSE forums for CHC.
  • If you have paid for care provided between 1 April 2004 and 31 March 2011, you must claim before the end of September 2012 for a refund of care home fees. The website for continuing care is: http://www.nhscare.info/ with a lot of advice and if you scroll down a bit you will find links to Steve's message board and misslawbore's message board too where you can ask questions. The Primary Care Trusts are so snowed under with claims that the government has decided to stop the flow (which will save the government a lot of money of course).
  • Firstly, there is no need to use solicitors or claims management companies you can do it all yourself. Though many people would rather let someone else handle their case. The choice is yours - don't let any tell you differently.

    You also need to take note that the deadlines are different for the different countries in the UK (or even whether you can claim or not) and that there are different cut-off times depending upon the period you wish to claim for.

    I have worked with the company behind the website I have linked below and know that it has all the up-to-date deadlines on the page; but please note I have not used their services in any way and this should not be taken as a recommendation - you should shop around if you want to use a solicitor (and contact referees etc if available).

    (Too new to post links - fair enough: so I would recommend you do a search and find a site with all the latest deadlines - though many have out of date info so compare around)

    Hello, Thank you for the Op.

    I am wondering if this could apply, to other residential care homes, such for mental health, respite, where instead of going into hospital, becuase there are no beds etc, That a private house is offered, But obviously money then comes into it.
    The person was discahrged from hospital 'so to speak' straight into the care home, for mental health, This was not a care home for the elderly.

    (I belive the place was payed for by family, rather then it coming from the nhs. This is something I need to find out. )

    But in the meantime, I wonder If I would be able to claim back the fees, as I was told it was 500.00 per week, the person, was there for 3,4 months.

    Would anyone have any information or suggestions please
