As we were sitting in a(nother!) traffic jam today, we saw a van from a large company and the driver was smoking.

My daughter asked me - if that is his place of work, is he allowed to smoke in the van?

No he isn't. The cab should be fitted with a no smoking sign.

It was my understanding you can smoke in a vehicle if that vehicle is yours & nobody else will be entering it.

For example: the 1 man band builder who owns his own pick up truck & there's only him driving it - he can smoke in it.

The builder who has 2 lads working for him can't.

^^ That was my understanding, though i'm not 100% on that.

You're wrong and the reason is that at some point it'll go to a garage where a third party will be driving it.

Its an asinine law TBH. Out of 20 years driving lorries mostly on agency so I never was in the same one two weeks running, I could probably count on the fingers of one hand with spares the number that as a non-smoker I found stank of cig smoke.
  • I know postmen cant smoke WHEN delivering, but if hes just walking around either after posting his letters or on his way to the van he can smoke, but not when he goes upto doors to post.. couldnt tell you about in the delivery vans

My hubby's a HGV driver. He is the only one that drives that lorry and he lives in there monday to friday, he smokes in it.

If that lorry was used by another driver who was a non-smoker, my hubby isn't allowed to smoke in it. Similarly if he ever carries a non-smoking passenger, he's not allowed to smoke in it.

If the lorry is used by two drivers who both smoke, they're still not allowed to smoke in it!

He was stopped not long after the law came into force in 2007 and the Police tried fine him for smoking in it (he was seen smoking whilst stationary). After hubby explained he was the designated driver and no-one else used the lorry, there was nothing the Police could do :-)

No - you are wrong. Unless the regular driver of the vehicle is travelling as a passenger and smoking.

I agree with you on one point though, it is an asinine law. But then again the law is an a55.
  • My biggest issue with people smoking in vehicles is the number of people who use the road as their ashtray. Having hot ash flicked in your face by a passing driver is not only grossly offensive but dangerous. And the number of drivers that deposit the contents of their ashtrays at the roadside is staggering. The cellulose fibres of a filter tip don't degrade and hang around for years.

I would just use an electronic cigarette as there is no smell or passive smoking.

But don't you risk and armed response unit if you do that and the road you're on been closed for hours?
