Confusion on notice to give

Hi Guys,

I was wondering if you could help me.

I am on a part-time Zero hour contract (as far as I am aware - there is no guarantee that I will have a shift).

I am looking for a new and in my contract it says that I have to give a months notice, even though I am not guaranteed a shift each week.

Where do I stand? Do I have to give a months notice or is there a clause or something where I can give less?

This is the first job that I have had.

    You need to give the notice stated in your contract or if there isn't one, a week.

    Have a word with HR and see if they're prepared to reduce it.

    With zero hours it works both ways,

    You just become unavailabe to do shifts.

    Then you can hand in notice any time.


    I don't think a "you can't work elsewhere" clause should be enforcable

    Indeed.

    In fact there is an argument in favour of not handing in your notice until you have done the last shift you want to work. The only exception would be if you normally agree your working days well in advance.

    If they are are under no obligation to give you work you may well find it dries up completely the moment you give notice as there is no incentive for them to keep you sweet!
