    It is legal I'm afraid. Nurseries usually hire as Part-time "as and when required" however, if you had a contract say 25 hours, there's nothing stopping the employer changing your contract to reflect the hours they want you to do now.

    If I remember right from my days of children attending childcare, I had to pay for their place even if we took them on holiday, so even if there are not the usual number s in the owner is still being paid for the children so can't use the no income statement surely?

    The drop in children attending is probably due to several leaving, to either take up nursery places within a school in September, or to start school in September. It is quite common for nurseries to have a reduced number of children at this time of year.

    you have contracts just not written ones.

    establishing the terms will be quite difficult as you have establishe some fleaxability, if it has never been less than 3 days that may establish contractual hours at 3 days since that is what you asked for.

    How are they working out holidays?

    They work out on holidays roughly like this.....full time....= days worked x 5.6.
    Set days ie., 3 days a week worked out the same.
    If no set days/hours....holidays are taken then employer adds up all hours worked that year then calculates from that.....consequently if this is not done mid-year too then there is often an over/under take of holidays.
