Help with Holiday Pay

Hi

The company I work for recently split up into two and because of the store I work in I would be part of the new company, owned by one of the partners of the old company. I was told the only thing that would be changing is my holiday pay, which is paid to me every 4 weeks with my wages, would be calculated as an average of my past 12 weeks work.

This got me thinking about my current holiday pay and I realised I have been getting the same amount of holiday pay, around 6 hours, since I began over 4 years ago. Its a Part-Time Job and im not not contracted to any hours but my hours change from week to week and its defiantly more than an average of 6 hours. In my Contract it said "Your holiday pay will be based on your average earning over the previous 12 weeks."

I may be wrong, but does this mean I add my hours up from the previous 12 weeks, divide them by 12 and multiply by my hourly rate? Assuming I am correct they have been seriously underpaying me in terms of holiday pay. Is there any way I can get this back?

If I am wrong could someone explain how I do work this out.

Thanks for any help on this

There are a few issues here.

You should be acruing holiday and taking it, not getting it paid monthly

    Minimum holidays is 5.6 weeks

    those side

Simple way to check you get at least the minimum holiday is to use 12.07% of the hours worked.

You need to resolve any outstanding payments as part of this transfer of employment.
