My staff aren't being paid - how to proceed?

I'm looking for some advice in how best to proceed here.

Bit of background...

Recently I was taken on as the PR manager for a company which is part of a larger firm. Theres been substantial issues with the staff that i've brought in not being paid, or being underpaid.

Head Office handles the payroll. I pass on the hours/timesheet to my General Manager, he sends them off to HO. Pay gets processed weekly. Due to budget cutbacks, commission and hours were cut as of this week. It doesn't effect past hours/commission that is owed.

The problem is, some of my staff haven't been paid for several weeks despite information that HO require being passed onto them (NI number, bank details, ID). This week, when they should all have been paid as I followed up all staff's accounts to make sure they were paid propperly.. one member of staff hasn't been paid, and another hadn't been paid commission they were owed. I suspect that all staff that were owed commission haven't actually been paid it, but I haven't been in to check their payslips/accounts.

Individual staff are owed upto £100 in comission.

This is what i'm asking:

Does the company have a legal requirement to pay out for past commission and hours, up until the point that it was axed? Are staff able to bring a group action? Could I, as their line manager, be brought into a court over this, either as a defendant, or witness, if an action took place?

I'm needing to support my staff, as I owe it to them - having recruited them in the first place, and many of them personal friends/contacts.

    You are not the employer, so you would not be the defendant. You might well be called as witness.

    Not a good situation. Take care to establish your facts on non payment and take care to establish whether the employer has valid reasons for any of this. If it is not put right by next payday, you will be in a difficult spot, where you amy have to apologise to your staff, which will put you close to the exit door I would think.
