Hi
Id really like some advice please but its a long one.....sorry.
About 5 years ago i cashed 7 cheques at a local cheque cashing company and rolled them over for around 2 years at a cost of £10 per cheque,i paid one off and was left with 6,during this time also suffered from health problems and still am now although got a diagnosis but it now means i can only work part time.
Anyway i struggled to keep up with these cheques and and basically fell into arrears, ive since tried to make various payments although again not consistent due to ill health.18 months ago i recieved court papers, which i filled in explaining my side and sent back, the creditor wanted me to pay £30 and i kept asking to pay £20,in the end i agreed to pay £30 as felt pressured into it,i recieved a letter from court to say that it had been agreed and that was that.I started making the payments until around last September when i struggled again due to having a miscarriage.
In May i recieved a letter from the court stating a judgement was being placed against me,i rang the courts and they said there was nothing i could do but wait until the judgement amount had been decided. On Wednesday i recieved a letter saying i have to pay £980 by the 9th July....it was the 11th so again i phoned the courts, meanwhile also emailed the creditor asking to reconsider letting me pay £20.
The court said that judement had been placed and that the creditor was applying for an attachment of earnings, she advised me to apply for a varied order which means i can again ask what i can afford to pay but it would cost me £45 and i havent really got the money.
Can somebody advise me what my next course of action is,i really dont know what to do next and im also concerned of anyone coming and taking my posessions,im really ill at the moment and this is making me worse as im frightened and scared, please help. Thanks for listening x

If they apply for an attachment of earnings and its granted then they money is taken directly from your salary. The amount taken from your salary is determined by how much you earn.
If you are employed it might not be such a bad option for you. The other option is to apply to the court to pay in installments again - but as they've said there is a fee to do this.
Regarding your possessions - if they are going for an attachement of earnings then it doesn't sound like they are planning to instruct bailiffs. If bailiffs did turn up them don't let them in the property.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Thankyou ive emailed the creditor but hes not replied probably doesnt want to.I did think wait to recieve the form for attachment of earnings as i dont have the £45 fee to vary it,Ive looked at the form online as the court told me what to look up and its asking for husbands income, now when i had the debt originally it was in my maiden name,im now married and the ccj has come in my maiden name, what i really want to know is when filling out the form what name do i put down and also do i have to disclose my husbands income if its nothing to do with him?0

if you have to beg or borrow the money for the variation order do it
If this goes to bailiffs it Will be HCEO and your debt Will more than double because of there fees
and just to make you aware if you have an outbuilding (garage shed) thats not attached to your property then they can force entry and remove goods (they cant force entry to your home )
have a look here there are plenty threads about HCEO fees

Hallowitch......... I was told by the courts yesterday they were looking into an Attachment of earnnings, she told me if Baliffs were coming id have a letter first and it would be recorded with them as the creditor had to apply for a warrant of execution is this correct?
