Please help im going to have a nervous breakdown!

i am looking for some advise. I was very silly and in 2005 ordered a video camera from a catalogue for about £300 maybe less. I dont have much of the paperwork left and just a few statements. This was from littlewoods AKA very.com anyway i did make some payments probably around £150 alltogether. Then i lost track for a while. They then added on lots of admin charges and interest which started making it harder and harder to pay back. The account then had a 42% APR charge on it and £5.00 admin charge everytime i tried to keep up. Anyway time went on and it was passed to debtors i have been fighting LOWELL over the interest they have now passed it to Fredrickson who are saying i have 7 days to pay £435 or face court and bailiffs. i have written to them stating i am in dispute over the interest etc. Im due a baby anyday and i dnt no what else to do?

Can it not be written off as its dated back from 2005?

    Well, if you've been disputing the interest etc over all this time, but otherwise acknowledging and making payments, then it's not likely to be statute barred. Only a period of 6 years without acknowledgement or payment might do that.

    If the disputed over interest is valid, then they shouldn't take further action until investigated. But "shouldn't" isn't "won't".

    Would probably be worth seeing what of the original (if any) paperwork Freds/Lowells can supply for you to check.

    Take a deep breath and try not to worry. You have a busy time ahead of you. Just offer them what you can afford, and don't worry about balliffs. Just don't let them in your house (bit like vampires!), don't leave doors or windows unlocked as they can enter legally this way.

The reason i stopped the payment was because by the time i paid £20 only about £8 went off the account the rest was on admin and interest charges which i could not afford. I tried to explain this to them but they said the charges were fair and were aggreed between us? i dont remember agreeng to payng this much interest.
  • Also the letter to send for the credit agreement if i send a pound is a cheque ok? or not as then they will have my acc number and sort code\?

    Should not matter, but if you are concerned then you can send a postal order instead.
