Advice re - Employment contract amendments.

Morning All,

I hope someone can advise regarding the following problem I have, Last year my team signed a change of contract agreements regarding the holidays we recieve, this was due to a manager deciding we got to many holidays but resulted in HR adviseing we are entitled to more. This agreement was signed and dated by the then manager and was to be put in our HR files, We now have a new manager who has decided we get to manay holidays and wants to change this contract apparently the change we signed previousely has oddly " Gone missing" Although i have a copy of my agreement and so do otheres has the company failed to comply to anything by loosing this document ?

  • The only way a Company can vary a contract is by agreement with the employee(s), this can be on an individual basis or by collective agreement. The fact that the company has 'lost' their copy of the contract is irrelevant particularly if your copy has both your signature and your managers. (Unless your contract has been cleverly worded to allow the company to make variations although this is usually more to do with your actual work duties as opposed too your entitlements) If the Company makes an alteration to your contract without your agreement, they may be in breach of contract.

    If you don't agree a change and the manager can prove that it is imperative for the business that you have a reduced holiday entitlement, then they could try dismissing you and then offer your job with the reduced entitlement.
    This would be a dangerous strategy for them.
