Hi All
Please can anyone help me i am at my wits end with Newlyn PLC re councl tax debt.
I have tried negotiating a Payment Plan with them but its like banging me head against a brick wall.
I had an agreement with them to pay £50.00 per month. I could no longer afford that without getting behind with this years bill so i wrote stating my position and requesting a lower amount. I also enclosed a statement of means,
I also sent a cheque for the first months payment at the lower amount which has been cashed.
I am now being bombarded with letters threatening entry/removal. no mention being made of my correspondence..
I just dont know what else to do to sort this out. I have even asked for it to be refered back to court so i can plead my case but this has been ignored too...
All help greatly appreciated Please.

Have the bailiffs ever been into your property? Do you have a vehicle outside the house?
Have you ever signed a walking posession order?
What council tax year does this relate to?
How much was the liability order?
What fees have they added? do you know?

No the bailiffs have never been in

Its for half of 2010/and 2011
They seem to adding £100 every letter
i have paid about £300 so far but can now no longer pay the initial aggreed amount of £50 per month need to reduce to £30 and that still make it hard to meet this years c/tax.
It seems you just cant reason with them, I do work but my pay has not increased in the last 4 years so really struggling.
Any advice will be welcome.

I would write to them and request a breakdown of all charges and payments on the account so far. I'd also send a copy of the letter to the council as well. Ask them to put the account on hold whilst you are waiting for your statement.
They are not allowed to add fees on for council tax debts of 10 pounds per letter. The fees they can charge are strictly set out in law and it's a maimum of 42.50 for 2 visits where no levy has been made I think. Ie they can come and deliver a letter/ try and levy but unless they can actually levy they can only charge 42.50 in total for the first 2 visits. After that they can't charge any more unless they can levy. No interest charges, no van charges, no late payment fee charges or anything else they will try and dream up.
When you get your reply then post back up here as they may be stupid enough to put their dodgy charges in writing.
National Debtline have a really good factsheet on dealing with council tax as well which will set out your rights etc.
I would try and pay them what you can each month - either by standing order or over the phone. Also make sure that you do not let them into your property (then they can start adding hundreds of pounds on charges) and park any car (if you have one) several streets away from where you live or that'll cost you loads as well if they levy that.
