Fired whilst signed off sick??

Hi all,
This is my first time posting and basically looking for some advice.
I am a student and have been working part time and full time for a small call centre from July 2010 and was signed of work from february 2012. I have not recieved any sick pay as my boss said i couldnt through him because i was part time and I have now been told I am not entitled because my boyfriend works. At first I kept calling and texting my manager letting me know how I was and what was going on but she seemed to be wanting me to take the diazapan (which i had been given four of for emergencies) all the time just to get back into work, even though I explained I had been given them for an emergency if I could not calm myself down and was already taking the medicine pescribed from my doctor. I never heard anything from anyone in the company and the only time I spoke to someone was when I contacted them. My house phone and mobile were both cut off as I had no money to pay the bill and I was in a bad way were I was barely speaking to my family, let alone work. I was told in May I would recieve a letter from the boss letting me know 'what was going on' and after asking my manager four times to resend it as I had not recieved anything and she kept asking me for my address, which I kept sending, and I still never recieved it, yet recieved my p60 in the post fine. Then I recieved my p45 (I think i have these the right way around, i recieved the one you get when you leave a job) in the post and have still heard nothing.:mad:
Is he able to just fire me whilst I am signed off with depression and have the sick notes to prove it??:(:(

  • You can be dismissed whilst off sick, but they should have followed a procedure. Is there any prospect of you being fit for work in the near future?

    Well my doctor still doesnt think I am fit for work but no procedure was followed, I basically just recieved my p45 in the post without hearing anything else from them. It was basically like I was not making him money so he didnt care. I mean, when I am not well this makes me feel worse that I cant even keep this job and have just been basically thrown out :(
  • You can appeal against the dismissal if you wish to. Was there any letter with the P45, have you spoken to them since receiving it?

    No letter and no, was going to phone but really dont feel up to him being horrible on the phone as he is really condescending. Its just made me feel really rubbish after I worked there and got on with everyone, made him a lot of money and im just let go like that, no goodbye or how are you or anything :/ horrible man hope karma bites him on the bum!!
  • You could take this further, potentially to a tribunal. If you did want to, you could write and appeal the decision so you don't have to speak to him, if that is easier? From what you have said though I do wonder if it would be more hassle than it is worth, if it is going to make you more ill?

    Yerr thats a good idea writing, and I know it just really annoys me the way he has done it, like he has been really horrible to other staff in the past (one girls dad died, a couple of days later he phoned and told her to stop blubbering, get back into work and make me money, and one of the lads step dad died to which he was told its not like he was your real dad). I just feel I have been treated unfairly, but I dont have any of the text messages/call records on my phone as I had to get a new phone a couple of months ago. I may phone the citizens advice and see what they say, what do you think? And thats true I dont think I could cope with any more stress! :( hahaha x
  • Half of me thinks you should teach him a lesson and take it as far as you can, the other half thinks you would be best to put it behind you. As well as CAB you could see if there is a mental health advocacy service in your area, they can talk through your options and support you through the appeals process if you choose to take that path.

    I know thats how I feel, Im torn!! Thank you for your help though I think I will phone them tomorrow and see what they say, thank you!
