The bailiff's been round

    what about our cars? They are both sort of outside our house - 50 yards away after the yellow lines stop- can he take these without a care?

    They can take your car if the debt is in your name. You should probably take care that they can't find it to do so. You and your wife should certainly continue to be careful they cannot gain entry to your house, too. Read this.
    its been going on for about 2 years. They wont let me pay monthly, then they disappear for 6 months then come back agian sticking an extra load of money on top

    If you are sure that they have not levied then all they can charge is a total of about £42 for visiting to "attempt to levy distress, where no levy was made". No more (though this might well be £42 per council tax year, if you owe more than one year, as councils consider each year's tax to be a seperate debt).

    You should complain to the council and the bailiff company, asking for a breakdown of fees charged and once you've established that the bailiff has added any incorrect fees, you should complain to the council about the wrongful actions of their agent (the bailiff is acting on their behalf, so despite what they may claim, they are responsible for his actions).

    You should insist that the council recall the debt from the bailiff because of these wrongful fees. Make it clear that you are happy to pay your outstanding tax and any debts incurred by the council as a result of your non-payment up to now.
