The bailiff's been round

I owe the council some council tax from ages ago. A bailiff has been round today & although the wife's not let him in, he's told her he's coming back tomorrow with a van & taking whatever he wants.
I have, about 6 months ago when he first came round tried to deal with the council as he's put about £400 on the bill & then he went away.
He's now back again. What can I do? If i phone him he'll give me the spin about court orders & the like. I want to pay my £400 bill but not the £863 that Mr Rosendales wants
How can I go about paying this off monthly? He says i cant
Any help will be fantastic, thank you

    Speak to the council, see if they will let you pay them directly.

    Has he ever been in the property?

    Did he leave any paperwork?

    Do you have a vehicle you own? (or does wife owns one if she was also named on the court order)?

    There are very specific amounts that can be charged by bailiffs in relation to council tax. If there has never been a walking possession order then the most he can charge is for 2 visits - just under £50 - if its for only 1 court order (if it only relates to 1 council tax year). Have you written to the bailiff to ask for a breakdown of the charges ever?

  • he has never been into the property. My wife's car is sort of outside/down the road a bit. I have just e-mailed the council asking them for time to pay because rossendales will just say no, ive been here before with them

    If he's never been in the property then he can't do that.

    Bailiffs will tell fibs like this to intimidate and scare if the think people don't know any better.

  • what about our cars? They are both sort of outside our house - 50 yards away after the yellow lines stop- can he take these without a care?

  • its been going on for about 2 years. They wont let me pay monthly, then they disappear for 6 months then come back agian sticking an extra load of money on top

    You probably need to put a concerted effort into getting the council to take it back then. And once they do, set up a regular payment.

    Otherwise this cycle is going to keep repeating itself.
