B&B Mppi,rejection for mis sell

Hi,
i recently claimed for a PPI mis sell, i remortgaged about 10 years ago, at that time i told the advisor that we did not wish to continue with PPI as both myself and my wife were paid for a minimum of 6 months if we were off work ill. unbenkown to me the payments were still taken, this was for the existing amount.
when i approached B&B they said they had received a telephone call from my wife several years ago asking what the payment was for so we were aware of the PPI at that stage (even though we strongly dispute this).
even though i have had several back operations that resulted in me being of work for extended periods and i never claimed under the PPI, and if i had wanted to carry on with the PPI when we remortgaged i would have increased the payments to cover our new mortgage (which was higher). B&B insist i was aware of the PPI and it was not mis sold, is there any point in me pusuing this??

Ok. looking at this as a complaints handler would you have some issues.
1 - you say you didnt want it. No way to prove that though. However, if you complained within months of seeing the payment go through your statement, then you would be highly credible and your complaint would be accepted and resolved. In your case, it took a decade. 120 payments went through. Credibility is not on your side.
2 - They say they have a call on file from your wife asking about it. That counters your complaint now and could event potentially allow B&B to timebar your complaint if they wanted.
3 - The fact you didnt claim doesnt make it mis-sold. You may have forgotten or believed you couldn't claim on the policy. Not uncommon for people to forget at all.
4 - the fact you didnt change it when you remortgaged is not good evidence. Many people keep existing insurances running when they remortgage. They dont all adjust them to suit the new mortgage.
Your complaint is very weak as it is only verbal allegations that cannot be proven by you. Unless it was set up wrong (which it isnt as B&B only did monthly premium) or there was some other failing, then you can see why they would reject it. Most complaints which are only unprovable verbal allegations need a more solid failure or a technical failing (like loans being front loaded single premium PPI) to succeed.I am an Independent Financial Adviser (IFA).
