HIP Pack - Where do i stand?

After two failed relationships and 4 years on the market, i have finally sold my House! :)

However i have just been called by my lovely estate agents ( :rotfl:) to say upon sale i will owe them £399 +vat for the HIP pack that i had to take out at the time of sale.

Unfortunately i signed a contract with my ex 4 years ago, when it was being put on the market to take out the HIP pack which would be free at sale if i used there solicitors during the sale.

I completely unaware of this (it had been 4 years) have used a different solicitor and now im going to have to pay them, this money.

Is there anything i can do, to get out of it. My house was in negative equity as it is, so as a result of all my recent hard work to pay off everything i owe. Im going to be back in debt again!

Any thoughts?

    Why did you use an alternate Solicitor if the contract you signed stated you had to use the agents?

    My thoughts are that you signed a contract saying you'd do something and now you have to follow it through.

    Why should whoever produced the HIP lose out because you have a bad memory and are in neg equity?
