I need advice desperately I'm looking to go bankrupt but I owe money to HMRC in the excess of 62k for overpaid Child Tax credits and working tax that's without mortgages and other debts, can someone advice on what to do, costs where do I go extra.

    Hi barneygtl and Welcome to the Bankruptcy (BR) Board. First step is to make a list of all your creditors, debts and assets. Secondly and most important is contact one of the following debt charities. Please try these they don't charge and are impartial. They will go through all your options with you and if they suggest bankruptcy then come back to this board and we will help you all we can. Also if your not ‘clicking’ with one of the Debt charities do try another. We advise you to try at least two others for your own piece of mind. Your BR could be refused if you have not sought advice.

    Is that £62,000 in overpaid Child Tax Credits and Tax Credits or does that include Income Tax as well?

    If so, that would look like a huge over-payment of means-tested benefits and would imply some sort of multi-year 'fraud'. Fraud wouldn't be covered by BR...
  • No its not income tax??? My husband left me with three kids so I claimed child and working tax, because we were never legally separated the HMRC didn't believe me and revoked the claim dating back to 2005!!!

    Because of the amounts involved, I suspect you will need specialist legal advice - the debt charities will (hopefully) point you in the right direction.

    Be very careful about signing ANYTHING - this may have very significant ramifications for any future BR.
