Hi all. We will be moving home in the next few weeks. We have a mortgage with the Halifax and have just received some paperwork from our solicitor. In the said paperwork is a paragraph, Occupation, which states that if there are any adults living at the property who are not on the mortgage itself, they will have to sign an occupancy form which must be witnessed by an independant solicitor at extra expense? my question is, our 24 yr old son lives with us, does this include him, being a part of the family etc??

He will have to sign, but I find it unbelievable that the solicitor would charge you extra for this....!I am a Mortgage Broker

I know he has to sign to say he'll move out when we do, but this appears to be he has to sign to move with us! I dont get it??? one of the conditions on the mortgage? maybe I'm reading it wrong....0

Sorry I was not clear, he has to say that he has no ownership rights to the property and just staying with you as family.

Only in that the form would have to witnessed by an independent solicitor. Who would obviously charge a notional fee.
Very true, read really quickly and did not read subsequent post. They are true, I certainly am one of those men that cannot do two things at once.
Pleased you got it solved easily though...I am a Mortgage Broker
