CCJ Advice

Hello All,

Just recently started to get my affairs in order and have had some great advice on here already, so thank you to all who have helped.

I followed up a CCJ i found on my credit file which a downloaded a few weeks ago.

I spoke to Northampton CC and they told me that the company who registered it are called SV Incorporated. The number they gave me for their solicitors is 0845 3133125. Having looked into it, it seems its for Bryan Carter Solicitors who also trade as Fredrikson International, and they have had a lot of negative feedback.

I dont know what the CCJ is for and wasn't aware of it until 3 weeks ago as I was not living at the address it was registered to at this time. I would like to find out what its for and sort it out, if I am responsible for it, as its only for just over £200.

I want to get it set aside with the aim of removing it from my credit file. What is the best process to do this? Northampton told me to get in touch with SV Incorporated first to establish if the debt is mine, but from what I understand, the company is very aggressive and will maintain it is. I dont want to speak to them, and if the debt is mine, pay it and then still have it on my credit file!!

Any help would be greatly appreciated.

    Have you obtained a copy of the judgement from the court? That should provide more info on the debt than just who obtained the CCJ.

    Don't speak to the debt collectors on the phone. Instead write to them and ask them for proof of the debt. See this template
    Letter when you know nothing about about the debt - AKA "Prove it" letter
    But possibly expand to say you have only recently become aware of the CCJ obtained against you.

    However if the debt is yours and you pay it - then it will still remain on your credit file for the remainder of 6years since the judgement date. The only way to remove it from your file would be through a set aside application, but until you know what it is you won't know whether you might have a case to get it set aside.

    If you think you are in with a chance of a set aside, get the set aside processed first rather than paying first. That way you have a little more bargaining power against BC, who won't give a damn once you have paid up.

    How do I go about getting a copy of the judjement from the court?

    I am confident that I can get it set aside as I was living elswhere at the time so I didn't recieve any letters, though I didn't write to inform anyone of my move due to depression at the time. My goal is to what find out what it is for, acknowledge it if it is mine, and then pay it, but most importantly, get it removed from my credit file as that is the only staing on there at the moment (I think!)

    What is the best way in doing this?

    A creditor only has to write to your last known address - and so not receiving court papers because you didn't tell them your address is not usually considered reason enough for a set aside judgement.
