MFS Portfolio Ltd ?

Hi,

I have been sorting out my husbands debts, as cut a long story short he has been on 2 lots of cancer treatment drugs for a blood disorder and whilst on the treatment got himself into a mess.

Since 2009 I have been paying Optima Legal two seperate amounts for his MBNA Credit card debts. I have always paid these on time one is for £40 and another for £60 a month. I paid them yesterday as normal and have today received a letter from MBNA stating that they had sold the debts on. I thought they had originally sold them to Optima Legal. Optima Legal have put a CCJ on our joint property and told me that the interest has been frozen.

If MBNA have resold this does this mean that the amount that I have in the letter will be increased?? One is for £2906.46 and another is £1180.21 and also what happens to the charge on the property would it be cancelled as they have sold it on. I didnt think they would do this as it has been paid on time.

    Its MFS Portfolio. was your oringinal debt with MBNA as well? The thing is when I first spoke to Optima Legal they were really nice and said had he taken it to court because he has paid the original debt 2 fold and because of his illness when he took out the card it would have been wiped clean. Dont mind paying BUT do hope that he dosnt get hit again with further charges, it seems like it is never going to end.

    My problem is exactly as you have described it, same companies, same amounts, same court action, same time.

    My other half is out with the letter I thought ours said MMF Portfolio might be wrong but if you google Motor mile finance you will find a DCA based in Bradford who deal in low end PDL's

    They seem to wish to put the wind up people by using scare tactics if you read the website (if its the same ones)

    However you will also find on the net that all is not quite right with these people. If mine are MMF then despite the scary next few weeks I am actually quite pleased as I can go for a F & F at a level I can afford.

    Optima hmmmm just another DCA. Say what they want to get you to pay. We are paying more than the CCJ because they harrassed us into it. Now we realise they shouldnt they sell on within 7 days of the letter telling them we were dropping back to the CCJ.

    They get caught in the cookie jar and then dont want to play anymore.

    As an aside if the debt was in your husbands name only but its a joint property you may wish to read the big thread about Charging orders.

    Its most interesting. Certainly takes the big stick away and when the big stick is gone then they realise they may have a debt thats gonna take years to pay off and they can do diddly squat about it.

    Think the thread is about a day or two behind us at the moment but keeps coming to the top.

    It was definately only in my husbands name. I am really good with finance and had I known that the medication he was on had nasty side effects, such as memory loss, suicidal feelings etc I would have taken control of his things. We used to keep things seperate and have seperate accounts. Now I have control of everything, dont want too but I have too.

    I think I will wait till they contact him. Then see if the amounts have increased and if they have I will tell them to take him to court and I also think I am going to TELL them what we can pay, which is the same as before and if they dont agree then SOD EM.

    Will take a look at that charging order thread thanks as I am sure that because it is in his name only they can only lodge a interest in it. As in if we sell the property (which we wont) then they get whats outstanding on the balance. Hope u get yours sorted out.

    Research of MFS gives you Marlin Finance West Sussex.

    Nice glossy website for you to look at.

    Pretty relaxed about it to be honest as CO isnt about chucking you out your house more about getting security. As everybody on here keeps saying DJ isnt likely to grant a order of sale for a couple of grand of CC debt when you are complying with a previous CCJ. Should think a DJ would be pretty narked the creditor has come to court if you are complying with a court ruling. Think thats what MBNA and Optima have concluded to.

    Seems MBNA thought it was a good wheeze way back in 2009 but now realise that the money could take forever and a day to get back and without a redetermination at court then really they should not be hassling us at all.

    So unless Marlin are about to take us all back to court to get said redetermination and you are paying your installments as per your CCJ then its just a different name. For me least I now know its not MBNA hiding behind Optima Legal. Now I now its a real DCA I have to deal with.
