Our unusual situation...

Hello all

My husband is a Debt situation I want to tell you about and see what peoples thoughts are...

When I met my husband 5 years ago he was in an IVA as a result of a failed business.

He'd been in the IVA about a year when we met (this was 2007)

November/December 2007 my Husband was contacted by a government agency who were investigating his IVA company who they believed had misold him his IVA and countless others. They were not wrong either there was no reason he should have been in an IVA he had no assests to protect and really should have just gone bankrupt.

Following advice he stopped paying the IVA company who disappeared from existence within weeks.

Shortly after, for reasons not relevant to this, my husband stopped working. He became a sort of house husband if you like. He does not claim benefits and has not earnt since then.

The original debts have been passed around, he used to get letters. It's been 5 years and the letters have practically stopped with only a couple of the original companies he owed money to chasing him. One being the tax man but even then its been a very long time since we've heard from them.

I should point out my husband is English but we live in Scotland.

We have looked in the past to getting him made bankrupt but this has been proved difficult because the tax office refuse to come up with a final figure of what the claim he owes. Each letter they send has a different amount. We have requested a final amount but they wont do it. The figures have been anything from £3000 to £700.

5 years ago my husbands previous accountant recommended a tax specialist to help sort that matter out as he didn't believe he owed the tax man anything. The very unhelpful tax specialist did nothing but ring up a huge bill for no work (the bill was at £300 before he had even received my husbands accounts!!). The bill went up and up and we refused to pay any more, he took out a CCJ against my husband and has kept his paperwork...

So we've been in a stalemate for a while. Yes it's in the back of our minds we really should sort it out..but I guess there has been no real pressure to. He has no money for anyone to take.

My real question is what happens to debts after time?
