help i need advice urgently!

over 3 years ago i was trying to sell a timeshare and i was approached by a company who did holiday clubs. they told me that if i paid them £7000 after 5 years i would get that back plus 75% of my timeshare cost. i was very dubious about this but i checked them out on line and with companies house and they were legit. though it pained me to part with more money i was desperate to get rid of the timeshare and try to retrieve some money back. last year we were informed that the holiday club company had gone bust and we had lost everything (£7000 plus timeshare) i was gutted. then i read one of martins pages and read about section 75. luckily i did pay the £7000 on my credit card.i followed martins advice with the letters and info need and sent it off to my credit card company. this happened 6 months ago . today i got a letter offering me £3250 in full and final settlement, with them saying that seeing the holiday club was solvent for a couple of years we could have had something out of our membership by using it and taking a holiday or two! we hadn't used it at all but there was no proof of this or if we had used it.
whilst im greatful to get something back im not sure whether the card company are trying to get out of their "contract" as such. i don't want to fight it and end up with nothing as this is better than nothing but im not sure whether they should pay me the full amount or not.? if anyone can help i would be really greatful.thanks

    yes, its normal when they do these refunds they will pro-rata it. you had the benefit of having the facility of the time share for two years.

    You cannot be issued with a 100% refund . just because you didnt use it isnt anyones elses fault, you obviously chose not too, so its irrelevant.

    why on earth do you spend £7000 and not use it? it sounds bonkers.
  • Thanks for the reply, i understand what you are saying and agree with you and i know i was bonkers not to use it but in the end package holidays worked out cheaper! I still have the timeshare apparently as the holiday club neglected to complete the paperwork for transfer.cheers!

    Hi just wondering the best way to claim under section 75 on mis sold Timeshare in Tenerife. The purchase was sent up as a club credit card with the limit of £25000. I was in a bad place at the time and told it was an investment which I would use for 2 years and then they would be put on resale. Ok I believed this Luxury apartment and then conned again after the 2 years had past told the share could not sell yet and would be another year or 2 before this could happen, but I would get much better return if I turned it into a Platinum membership gaining access to Sunseekers for week as alternative. Stupid me signed again another 1 year BNPL credit card which I was told I would be in a position to pay both in full before it was due to be paid. another 2 years later stuck with large debts and still no plans to resell the Platinum Cub Paridiso as it was taken over by SilverPoint now will only be ready for resales in 2015. Help I am now unemployed in serious debt trying my hardest to keep up maintenance fees by renting out each year. CAN I claim section 75 I can't remember if I paid one deposit on old MBNA credit card but know one deposit was paid with Nationwide Flexaccount debit visa. Both were created as Credit card (I never saw card) by the Resort Properties Clydesdale / Barclays Partner Finance. I have loads of paperwork and statements showing interest and charges, I need to get these debts wiped off before I go bankrupt. I feel the whole thing was a form of money laundering and I was targeted as I was suffering from depression after my devoice. Any help appreciated....
