rossendales bailiff and ct 1992 urgent help

Hi,

I was sat in my home yesterday afternoon and the bailiff just walked in as my door is just has a open handle i thought it was the kids comimg in,needless to say i got a shock of my life when he told me who he was, i asked him to leave and he said no am going nowhere untill i have £293 owing from poll tax drom 1992, i was shocked i have an agrrement with council anyway which i pay for money which i owe (and never missed a payment with them) i telephoned lcc while he was towering above me and they said nothing to do with us as its poll tax and to old a debt ? i have no correspondance with any debt from 1992 first i have heard of it, but he coming back in 48hrs, dont have the money am scared of him, o am alreeady ill, without him adding to it, please can someone advise me.

    you must keep your doors locked at all times do not let him in tomorrow
    do you if the local authority have a liability order against this debt ?
    was he there as a debt collector or a bailiff (2 very different things) what paperwork did he leave you

    Its everything to do with the council its there debt regardless of who is enforcing it

    what council is it
    what bailiff firm/debt collectors is it
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    thanks for the reply, the letter says

    Magistrates liability order/warrant of execution dated 21/10/1992
    will return in 48hrs

    Liverpool city council

    I've asked a few other people to take a look. Hopefully they will this evening.

    Poll Tax liability orders could be granted anywhere up to 20 years after the amount became due - once the order was granted then the monies are outstanding for as long as the council wishes to pursue the balance.

    As mentioned above the council may have used a debt collector but its likely he is a bailiff with a much wider range of powers.

    Did he take a list of goods when he was in the property ?
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    A point of note is he has only a letter claiming orders.
    Lock doors and inform them they will not get anywhere until these "orders + warrants" they claim to hold are produced and served, if they can not, they are not bailiffs, just abusing the power of one.
    If they claim to have warrants, make them produce them and instruct them they will be repelled until they do so.

    Just hope a distress notice was not signed
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    I signed nothing, he just barged through the living room like i sad i got the shock of my life i asked him to get out even before i knew who the big hug was, but he refused, to be honest i was and upset and frightned never had anything like this before.

    A levy does not need to be signed , he can complete it without a signature.
