mis sold mortgage and ashton fox

Hello i received a phone call yesterday from Ashton fox solicitors and after quite a lengthy discussion it came about that i was mis-sold a mortgage a few years ago. they are sending out paper work to me and i am interested in proceeding but they will take 30% of what i will be entitled to plus a further 20% deduction for tax (i found this out after discussing all my details) i think it is way too much and after researching the company i have not found very many good reviews

Is there a way i can claim any monies owed to me through another more respectable company or maybe even myself?

Sorry if this is a bit of a ramble but it is the first time i've used a forum!

    These sorts of companies ask you questions which you can only answer yes to, to make it seem like you have been miss sold.

    Miss selling a mortgage is quite difficult to do.

    Why do you think you have been miss sold to?

    but the answer is yes, you can complain to whoever it was that sold you the mortgage, if they disagree then you can refer it to the financial ombudsman - all of which will cost you nothing.

    Thats not all..

    Once they get you interested enough you can smell the money, they will want an upfront fee and then you are unlikely to hear from them again.

    This is a gutter dwelling kind of industry and as ACG said it is incredibly unlikely you can be missold a mortgage.

    If you give the details, do expect they are likely to be shot down in flames as most are.

    If you pursue this, go in with your eyes wide open

    Advance fee fraud is when fraudsters target victims to make advance or upfront payments for goods, services and/or financial gains that do not materialise.

    Im being devils advocate... There could be a genuine reason.
    Chances are if your happy with it until someone tells you otherwise then its unlikely to be miss sold...mis-bought maybe?

    But were all here to help if there is a genuine miss sale so im happy to remain open to whatever reason.

    Although, work calls so might be a few hours before i check back.

    This nonsense is never ending.

    Interestingly I got this email earlier in the week ..



    With dozens of companies jumping on the bandwaggon of claims for missold mortgages, insurances and anything else they can thing of - it is important that you understand their techniques.


    With paid google adword placements (known as 'pay per click' because the advertising company pays every time someone 'clicks through' to their websites) linking to sites who ask questions like ...

    Have you had a mortgage in the last 10 years ?

    Did you use a mortage broker ?

    and then state ...

    Good news !! You can claim between £5,000 and £50,000 (or similar)

    ... and then encourage the viewer to place a vexatious claim via them against the, almost certainly innocent, mortgage broker concerned.





    • The broker will then waste several hours of their time responding to the resulting data protection demand
    • The broker will then loose hours of sleep worrying
    Such claims will almost certainly be rejected by the broker (DA), the broker's network (AR) or whoever holds the responsibility to do so.


    The claims company will then ignore that finding and take the case through the FOS procedure and ...





    • The broker will lose many more hours sleep
    • The broker will have to cough up the £500 FOS fee
    .... and then, in the majority of cases, the whole thing will be rejected and the claims company will head off to process the next vexatious claim (leaving the mortgage broker £500 short, behind on work, dog tired and a nervous wreck).

    It is therefore important that you understand their techniques .........



    Now the secret to understanding is research and I suggest you personally invest 15 minutes a day for the next couple of weeks as follows ....

    1) Spend ten minutes throwing any mortgage type searches into Google and look at which companies have paid goodle adword placements trawling for clients to make such vexatious claims - then click on their
    paid google adword placements so that you can see how their sites operate and what it offers - you can then be prepared to run your business better (it will only take about a minute per site to research the necessary details)

    2) Spend the remaining five minutes forwarding this message to other mortgage brokers and finance professionals so they can do their research and improve their businesses as well (its always nice to help others).


    Yes, this is a good old fashioned chain letter - and by my calculation if just 20% of the mortgage broker recipients action this they will generate 327,501 research visits to claims company sites over the next two weeks and be much better researched as a result (perhaps they could claim for it on CPD as well) - and I will have single handedly (with a little help from you) educated all the registered brokers, advisers, their paraplanners, administrators and secretaries appropriately.

    Research is King !!



    Incidentally the 'claims industry' would be pleased to sponsor this vital reseach and training programme to an estimated level in excess £250,000 over the two weeks - what nice people !!

    at the time my variable rate mortgage (which i was tied into) was going up and up. My partner had just started receiving incapacity benefit and i was part time working so we wanted to fix our mortgage and sought advice from a broker that had contacted my mother in law. he charged us £1000 (added to the mortgage) and assured us that everytime we had to remortgage in the future he would do it for free also he said he'd found us a mortgage that was the same payment same term and £3000 back in cash so being young and nieve we agreed looking back we should have knocked years off or reduced payments etc.

    What reasons do they give for complaint?

    A lot of the posts from others in the past have given complete and utter BS reasons. Things like brokers taking a fee or fees being added to mortgage (both of which are perfectly fine). A number of these companies appear to put in template letter complaints giving a large number of complaint reasons hoping that one will stick and they will get lucky. Typically, single premium MPPI where that has been done.

    Also, it is important to note that the Solicitors Code of Conduct prohibits solicitors from using cold calling, on the basis that it is judged to be unethical and unfair to the public for solicitors to promote their legal services in that way. So, a company cold calling you and presenting themselves as solicitors would be in breach of that code of conduct. Do you want to transact with a firm that is willing to break it's own code of contact in an attempt to get money out of others?
