How to Claim Student Fee Refund Under Section 75 on Cancelled Credit Card

Hello,
I am facing a bit of a dilemma in finding precise information related to my situation. I’d be grateful if Martin or someone can point me in the right direction.
I understand I can claim money for services not rendered from my credit card provider however my situation is as such that I paid for full 4year course fee for my cousin to his institute, half via credit card and the other half by bank transfer (both HSBC). After studying a year with that institute he had to return back home due to ill health of his father and requested a refund which they have refused. Although their general terms & conditions do not cover a refund policy for withdrawals under “unforeseen circumstances” they still maintain he is not eligible for refund of remaining fee. My question is, can I claim a full refund from my credit card company under section 75, although I have written communication with the institute confirming I will be paying his fee so contract is in effect between me and them? If not then what are my options under consumer credit act?
